Special meeting of the Village Board of Trustees was held on May lO~ <br />1965 at 7:30 P.M. in the Mesier Homestead. <br /> <br />Those present: Mayor Furnari, Tr. TemPle, Tr. Bain, Tr. Napoleon, <br />Tr. DiDomizio, Tr. VanVoorhis and Att. ?earse. Tr. Cheetham was <br />absent. <br /> <br />Motion by ~Tr. Napoleon and seconded by Tr. Temple that Notice of <br />a special meeting be waived. Carried. <br /> <br />Purpose of the meeting to discuss the suit against the Village. <br /> <br />Att. Pearse discussed the different aspects of the suit and read the <br />following Resolution: <br /> <br />WHEREAS, RAYMOND J. MARSHALL hascommenced an action in the Supreme <br />Court~ Dutchess County, New York, against the Village of Wappingers <br />Falls, the Village Board of Trustees of the Village of Wappingers <br />Falls, consisting of PETER C. FURNARI~ JAMES VAN VOORHIS~ ANTHONY <br />DI DOMIZI0~ J~S TE~LE~ RAYMOND BAIN, DOMINIC D. NAPOLEON~ JOHN <br />M. CHEETHAM ~JD LEO LO~NEY~ the Village Clerk, as defendants: <br />and <br /> <br />WEEREAS~ said action requests the Supreme Cou~t to make certain <br />determinations affecting the zoning ordinance of the Village of <br />Wappingers Falls~ and adjudging the same to be void and of no, effect; <br />and <br /> <br />WHEREAS~ the Village Attorney, William H. Pearse, has requested the <br />Board to authorize the retention of and to retain additional attorneys <br />to assist him in the defense of said action on beBaIf of all of the <br />persons named as defendants~ they being Village Officers; <br /> <br />BE IT RESOLVED that this Board directs the Mayor~ Peter C. Furnari~ <br />to retain Russell E. Aldrich~ an attorney-at-law~ Market Street, <br />Wappingers Falls, New York~ as attorney to assist the Village Attorney <br />in the defense of said-action, and to defend the same in the Supreme <br />Court, Dutchess County, on behalf of the defendants therein named. <br /> <br />Motion by Tr. Napoleon and seconded by Tr. Bain that the above Res- <br />olution be adopted carried unanimously. <br /> <br />Motion by Tr. Temple and seconded by Tr. Bain that Mr. Ian McDonald <br />be appointed assistant to Attorney for work on the Law Cases. Carried. <br /> <br />Motion by Tr. Bain and sevonded by Tr. VanVoorhis that meeting be <br />afjourned.
