271 <br /> <br /> A Special meeting of the Village Board and Village Water <br />Board was held in the Mesler Homestead on Nov. 28,1961 at <br />8:30 P.M. <br /> Those present, Ill members of the Village Bo~rda the Water <br />Board had two of its three members present, Mr. ~. ~iMarco <br /> being absent. <br /> The re,son for this meeting was to resolve the differences <br />between the Village and Water Board. <br /> The Mayor called the meeting to order and opened the meeting <br />to general discussion. <br /> Mr. Fr~e~ than stated that he felt that the money to <br />the amount of $?}6.~0 for expenses to a convention, be paid, as <br /> the Village Board had passed on this in the Water Board budget, <br />where the amount was $ 350.00. <br /> He then spoke on the payment, and ft×fng of the water box <br />for Mr. Caparar. He read an ordinance as follows, <br /> (Section 2?7,228, and 229 of ~hapter ~l~ of the Laws <br /> of 1897, are applicable to the Water Commission~ and re~d as follows;) <br /> <br /> Section 227 Supply pipes c~nnecting with mains and used by private <br /> owners or occupsnts shall be laid and kept .in repa~i at their expense. <br /> Such pipes can only be connected with the mains by the permission <br /> and under the direction of the Board of Water Commissioners. a member <br /> of the Board or its authorized agent may at any time enter a building <br /> or upon premises where water is used from supply pipes and make <br />necessary examinations. <br /> <br /> Section 278 The Board of Water Commissioners may adopt ordinances <br />not inconsistent with law, for enforcing the collection of water <br />rents and rel~ting to the use of water and may enforce <br />observance thereof by cutting off the supply of water or by tSe <br /> imposition of penalties. <br /> <br />Section 220 The Board of Water Commission shall establish a <br />scale of rents for use of water, to be calle~ Water Rents~ and to be <br />paid at such times as the Board may prescribe. S~ch rents shall <br />be a lien on the real property upon which the water is used and <br />such lien is prior and superior to every other lienor claim, e×cept <br />the lien of an existing tax, and the Board of Water Commlssioners~ <br />may bring and maintain an action in the name of the Village for <br />for the foreclosure of such liens for such rents. <br /> Mr. FrieS~ than said that he felt that the Village Board ~ <br /> should hold to the above ordinance, they now had. <br /> Trustee °tlvestri, made a motion that the ordinance <br /> and rules and regulation of the Wster ~om~Ission , be <br /> carried out. ~hls was seconded by Trustee F~tzpatrick. <br /> The Mayor called for a r~lI call vote. , voting in favor <br /> were Trustees. Reilly~ Van oorhts, ~tlvestrt, Temple, <br /> ~ftzpatrick, ~anale. ~o~ing against~was Mayor MB~loskey, <br /> on general conditions, <br /> m~e motion was carried 6 to 1. <br /> ~{r. Fries than broUght up the Park ~ommm. request~ <br /> on rent from the Water ~oard to help maintain the building. <br /> He stated that the Water Dept and the Police ~ept. moved <br /> into the Mesfer Homestead, Village property, to save money <br /> in the form of rent. Trustee Canale said that he felt that <br /> the Water Board and the Park ~omm., should meet, and see <br /> if they could reach some agreement on this matter. Mr. <br /> Fries said that if the Board wanted this they WOUld do so. <br /> <br /> <br />
