MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 4/11/06 <br /> <br />Present: Lloyd Frink, Chairman, Frank Barresi, Vice Chairman, Scott Davis, <br />George Dansereau, Allen Firstenberg, Floyd Hood <br /> <br />Others Present: <br /> Kathleen Rutledge <br /> William Raiche <br /> Donnie McCormick <br /> <br />Rob Rutledge <br />Pat Raiche <br />Kevin Bmtting <br /> <br />Meeting was called to order at 7:30 p.m. Clerk took roll call - all members present - <br />Absent was Village Attorney Viglotti. <br /> <br />Mr. Frink welcomed Mr. Hood as the new alternate to the Zoning Board of Appeals <br /> <br />First order of business was to elect Chairman. Mr. Ban'esi made a motion to appoint Mr. <br />Frink as Chairman, seconded by Mr. Davis. Roll call vote - Mr. Barresi - Aye, Mr. <br />Davis - Aye, Mr. Danserean - Aye and Mr. Firstenberg - Aye and Mr. Frink - Abstain. <br /> <br />Mr. Frink read for the record the lead agency intent request for Kathleen Rutledge. Mr. <br />Frink made a motion to consent to the Planning Board being Lead Agency seconded by <br />Mr. Davis. On roll call vote - Mr. Frink - Aye, Mr. Davis - Aye, Mr. Barresi - Aye, Mr. <br />Firstenberg - Aye and Mr. Dansereau - Aye. <br /> <br />KATHLEEN AND ROBERT RUTLEDGE~ 6 HILLSIDE AVENUE <br />First on the agenda was the request of Kathleen Rutledge, 3 Widmer Road seeking an <br />area variance to be able to have a garage less than the required 5 ft. from the property line <br />at 6 Hillside Avenue. Property is in the process of being subdivided. Applicant gave <br />Clerk Notice of Mailings and also Affidavit of Service from Southern Dutchess News - <br />legal notice was published in their March 29, 2006 edition. <br /> <br />Mr. Frink stated applicant presented a request for an area variance for an existing garage <br />that is 3.3 ft. from the property line. Mr. Frink asked how long the garage existed and she <br />answered since the early 1960's. Applicant stated she is subdividing the lot and plans to <br />sell lot 1 (where garage is located) as a single lot and then sell lot 2 where has an existing <br />house on it. A question was raised about the fence that divides her property with Mr. <br />Cerino's property and applicant stated she believes the fence belongs to Mr. Cerino. She <br />stated she has no plans to demolish the existing garage. Mr. Frink asked if there were <br />ever any complaints or concerns about the garage and applicant answered she has never <br />heard of any. At this point Mr. Frink read a letter from Made Megna who lives at 4 <br />Hillside Avenue (copy of letter on file in the Zoning/Planning offices) who objects to the <br />subdivision and a letter from Mr. George Moran who lives at 17 Hillside Avenue - Mr. <br />Moran does not object to the subdivision. <br /> <br /> <br />
