MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 12/13/05 <br /> <br />Present: Lloyd Frink, Chairman, Frank Ban'esi, Allen Fimtenberg, Scott Davis <br /> <br />Absent: <br /> <br />George Dansereau <br /> <br />Others Present: <br /> Christopher Moschillo <br /> Rebecca Mamuyac <br /> Alan Weitlich <br /> Sharon Williams <br /> Gerardo Diaz <br /> Cecilia Lopez <br /> <br />Renee Ellis <br />Anthony Mamuyac <br />Jon Detterline <br />Jeff Smith <br />Melissa Diaz <br />Kevin Bmtting <br /> <br />Meeting was called to order at 7:30 p.m. Clerk took roll - Mr. Dansereau was absent. <br /> <br />Mr. Ffink read a letter from Mr. Russell stating as of November 23, 2005 he has resigned. <br />Mr. Russell's resignation was accepted by the ZBA with regret. <br /> <br />At this point Mr. Frink stated the ZBA needed to elect a new Co-Chairman. Mr. Davis <br />made a motion to appoint Mr. Barresi as Co-Chairman. Motion seconded by Mr. Frink. <br />On roll call vote - Mr. Davis - Aye, Mr. Frink - Aye, Mr. Firstenberg - Aye, Mr. Barresi <br />- Abstain and Mr. Dansereau - Absent. <br /> <br />At this point Mr. Frink made a motion to go into Executive Session to consult with <br />Counsel regarding an Aggrieved Party appeal - Mr. Frink's main concern is the <br />timeliness of this appeal. Motion seconded by Mr. Davis. Unanimously carried. <br /> <br />Board returned to regular session at 7:42 p.m. It was stated that no action occurred in <br />Executive Session. <br /> <br />LOU SNELL AGGRIEVED PERSONS APPEAL <br />It was stated that Mr. Snell has filed an aggrieved persons appeal with the Zoning Board <br />of appeals - Mr. Snell is appealing the Planning Board decision that occurred in May <br />2002 regarding a street. <br /> <br />Mr. Frink made a motion that the ZBA not docket requests and not hear appeal for the <br />following two reasons: (1) lack of subject matter jurisdiction and (2) untimeliness of <br />appeal. Motion seconded by Mr. Davis. Unanimously carried - Mr. Dansereau - <br />Absent. Secretary was informed to write letter to Mr. Snell informing ltim of Board's <br />decision. <br /> <br />ADVANCED AUTO PARTS~ CORNER OF OLD ROUTE 9 AND ROUTE 9 <br />Next on the agenda was the decision on the closed public hearing on the request of <br />Wappingerwood, LLC, 4017-B State Street, Schenectady, NY seeking a variance fi.om <br />Section 151-19(D)(2) of the Zoning Ordinance to reduce parking lot front setback from <br /> <br /> <br />
