Edward Hunt <br />Mickey Pied <br />Cai Lawrence <br /> <br />Meeting was called to order at 7:30 p.m. It was noted for the record that Village <br />Attorney Viglotti was not present at the meeting. <br /> <br />LINDA GIANCARLO~ 56 NORTH MESIER AVENUE <br />First on the agenda was the public hearing on the request of Mrs. Linda Giancarlo, 56 <br />North Mesier Avenue seeking an area variance to be able to install an 8 ft. fence along <br />the rear line of her property - allowed is 6 ft at the above address. Mrs. Giancarlo stated <br />she had published her legal notice in the May 25, 2005 edition of the Southern Dutchess <br />News (she supplied the Board with a circulation copy of that newspaper) which does <br />contain the publication for the public hearing - at this point Mr. Frink made a motion that <br />this document be used as accepted affidavit of publication. Mr. Davis seconded the <br />motion. On roll call vote - Mr. Frink - Aye, Mr. Davis - aye, Ms. Ruder - Aye, Mr. <br />Barresi - Aye and Mr. Russell - Aye. It was stated that Dutchess County Dept. of <br />Planning responded to the Zoning referral with a "matter of local concern" comment. At <br />this point Mr. Ffink asked applicant to give testimony as to why she needs an 8 ft. fence <br />versus the allowed 6 ft. fence. Applicant stated her residence borders the Bank Plaza <br />which includes a bar, adult retail store, Chinese restaurant and a tile store. Mr. Frink <br />asked applicant what makes her property difference than her neighbors who have this <br />same type of situation - applicant stated directly behind her property are the dumpsters <br />and rear doors - it is where all deliveries are made - there have been times when people <br />have walked through her property to get to the Bank Plaza. Applicant stated with the <br />topography of her property she has a clear view of the garbage trucks making their <br />morning run. The trees used to block their view but the bottoms of the pine trees are now <br />barren. Applicant also stated she is a widow living alone - and feels she needs the fence <br />for security reasons also. Mr. Frink stated applicant has submitted 8 photographs for <br />review and asked how took the photographs - applicant stated her son took the photos. <br />Mr. Frink then asked Mr. Giancarlo when he had taken the photos and he <br /> <br /> <br />
