MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 11/9/04 <br /> <br />Present: Lloyd Frink, Chairman, Susan Ruder, Vice Chairman, Newell Russell, <br />Dave Crawford, George Dansereau and Mary Ann Loncto <br /> <br />Others Present: <br /> Mary Ross <br /> Trustee Visentin <br /> Gerald Blakey <br /> Trustee Hilderbrand <br /> Trustee Enson <br /> Trustee Marshall <br /> Armand Alfonso <br /> Donnie McCormick <br /> George Kolb <br /> Victoria Matthews <br /> Al Weitlich <br /> <br />Barbara Tomlins <br />Tracy Blakey <br />Tom Morris <br />Bob Morris <br />Trustee Cerino <br />Mayor Lawrence <br />Robbie Alfonso <br />Heather McCormick <br />Judy Morris <br />Jeff Smith <br /> <br />Meeting was called to order at 7:30 p.m. Clerk took roll call - all members present. <br /> <br />Motion by Mr. Frink, seconded by Ms. Ruder to approve the minutes of the October <br />meeting with suggested amendments. (Amendments are of a grammatical nature and do <br />not change the content of the minutes). Motion unanimously carried. Copy of amended <br />minutes on file in the Planning/Zoning office. <br /> <br />Mr. Frink stated as a matter of business within five days of the meeting the Board must <br />file a resolution/findings of fact with the Village Clerk. Mr. Frink stated he has received <br />a memo from the Village Clerk stamped with "Received - October 15, 2004" <br />acknowledging receipt of Findings of Fact from the previous meeting. Subsequent to <br />that date Ms. Ruder signed and made the "Findings of Fact" formal as Vice Chairperson <br />of the ZBA. <br /> <br />Next item of business the Board is in receipt of two letters - one dated October 24, 2004 <br />from Gerald Blakey and one dated October 27, 2004 from Tracy Blakey - instead of <br />reading the entirety of the letters - they are complaints directed both to the ZBA and the <br />Code Enforcement Officer - since the Code Enforcement Officer has been appointed and <br />confirmed - he is the proper avenue to direct these complaints. Mr. Frink asked if any <br />member of the Board had any objection to directing these complaints to the Code <br />Enforcement Officer. No one on the Board had any objections. Subsequent to these <br />letters as a matter of public record, the Code Enforcement Officer had spoken to Mr. <br />Frink requesting an opinion on a matter - and he told him the best avenue to proceed was <br />to form his own judgment and clearly by Village Code be is empowered to rectify <br />situations which he considers unsafe and referred to him to Section 151-20(E) of the <br />Village Code. Mr. Frink went on to state that was the extent of the conversation he had <br />with Mr. Brutting - Code Enforcement Officer. <br /> <br /> <br />
