MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 7/6/04 Present: Lloyd Frink, Chair, Newell Russell, Dave Crawford, George Dansereau, Attorney Viglotti and Mary Ann Loncto Absent: shortly. Susan Ruder - Chair stated Ms. Ruder will be late but will be arriving Others Present: Mike Witkowski Darlene Smith Tracy Blakey Rob Alfonso Barbara Tomlins Bob Morris Joan O'Brien Heather McCormick Donald Smith Pat Balash Gerald Blakey Armand Alfonso Rudy Tomlins Jori Adams, Esq. Don McCormick Meeting was called to order at 7:30 p.m. Secretary took roll call - all present - including Attorney Viglotti except Ms. Ruder. Mr. Frink stated she would be a bit late. Mr. Frink stated he was in receipt of correspondence from Tracy Blakey dated June 21, 2004 which seems to be unrelated to the matter on the agenda for the evening - therefore Mr. Frink stated he will paraphrase the contents of the letter - as it seems to be a disagreement between the Code Enforcement Officer and Ms. Blakey as to the proper avenue of relief. There is no official request for an appeal or interpretation - therefore the ZBA has no authority to act on the letter. BARBARA TOML1NS~ 16 WEST STREET First on the agenda was a public hearing on the request of Judy and Robert Morris and Tracy Blakey seeking an interpretation, as aggrieved person(s), to a particular section of the Zoning Ordinance as it is felt that the Zoning Administrator is not using the proper Interpretation. The Section is 151-25(B), (2) and (3). The above mentioned parties are aggrieved by the unlawful issuance ora building permit for premises located at 16 West Street and owned by Barbara Tomlins. Applicant stated that the publication in the newspaper was published seven (7) days prior to the meeting rather than the mandated ten (10) days prior to the meeting. It was stated that the applicants would readvertise the hearing tbr the mandated 10 days prior to the next meeting. Mr. Frink stated he agreed with the applicants and went on to state that insofar as the statutory provision for proper notice of the hearing was not met. Therefore there are no agenda items for this evening. Mr. Dansereau made a motion to approve the minutes of the June meeting, seconded by Mr. Russell. On roll call vote-Mr. Frink - Aye, Mr. Russell - Aye, Mr. Crawford - Aye, Mr. Dansereau - Aye and Ms. Ruder - Absent.
