MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 7/6/04 <br /> <br />Present: Lloyd Frink, Chair, Newell Russell, Dave Crawford, George Dansereau, <br />Attorney Viglotti and Mary Ann Loncto <br /> <br />Absent: <br />shortly. <br /> <br />Susan Ruder - Chair stated Ms. Ruder will be late but will be arriving <br /> <br />Others Present: <br /> Mike Witkowski <br /> Darlene Smith <br /> Tracy Blakey <br /> Rob Alfonso <br /> Barbara Tomlins <br /> Bob Morris <br /> Joan O'Brien <br /> Heather McCormick <br /> <br />Donald Smith <br />Pat Balash <br />Gerald Blakey <br />Armand Alfonso <br />Rudy Tomlins <br />Jori Adams, Esq. <br />Don McCormick <br /> <br />Meeting was called to order at 7:30 p.m. Secretary took roll call - all present - including <br />Attorney Viglotti except Ms. Ruder. Mr. Frink stated she would be a bit late. <br /> <br />Mr. Frink stated he was in receipt of correspondence from Tracy Blakey dated June 21, <br />2004 which seems to be unrelated to the matter on the agenda for the evening - therefore <br />Mr. Frink stated he will paraphrase the contents of the letter - as it seems to be a <br />disagreement between the Code Enforcement Officer and Ms. Blakey as to the proper <br />avenue of relief. There is no official request for an appeal or interpretation - therefore <br />the ZBA has no authority to act on the letter. <br /> <br />BARBARA TOML1NS~ 16 WEST STREET <br />First on the agenda was a public hearing on the request of Judy and Robert Morris and <br />Tracy Blakey seeking an interpretation, as aggrieved person(s), to a particular section of <br />the Zoning Ordinance as it is felt that the Zoning Administrator is not using the proper <br />Interpretation. The Section is 151-25(B), (2) and (3). The above mentioned parties are <br />aggrieved by the unlawful issuance ora building permit for premises located at 16 West <br />Street and owned by Barbara Tomlins. Applicant stated that the publication in the <br />newspaper was published seven (7) days prior to the meeting rather than the mandated <br />ten (10) days prior to the meeting. It was stated that the applicants would readvertise the <br />hearing tbr the mandated 10 days prior to the next meeting. Mr. Frink stated he agreed <br />with the applicants and went on to state that insofar as the statutory provision for proper <br />notice of the hearing was not met. Therefore there are no agenda items for this evening. <br /> <br />Mr. Dansereau made a motion to approve the minutes of the June meeting, seconded by <br />Mr. Russell. On roll call vote-Mr. Frink - Aye, Mr. Russell - Aye, Mr. Crawford - <br />Aye, Mr. Dansereau - Aye and Ms. Ruder - Absent. <br /> <br /> <br />
