MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 3/2/04 <br /> <br />Present: Lloyd Frink, Chair, Susan Ruder, Vice Chair, Mike Kocan, Newell <br />Russell, Dave Crawford, Attorney Viglotti and Mary Ann Loncto <br /> <br />Others Present: <br /> Kevin Baccomo <br /> Nancy Lowney <br /> George Moran <br /> Mike Witkowski <br /> Crys McCurin <br /> Steven Constable <br /> <br />Klm Hanford <br />Tom Morris <br />Rob Alfonso <br />Steve DeVizio <br />Chris Scott <br />Michele Grieg <br /> <br />Meeting was called to order at 7:30 p.m. <br /> <br />ARC~DC~ 17 UPPER HENRY STREET <br />First on the agenda was the proposal from Dutchess County ARC-DC for property <br />located at 17 Upper Henry Street seeking area variances (1) rear yard setback for an <br />existing building on property and (2) variance from the parking requirements for a two <br />family house. Applicant is in the process of subdividing property, Mr. Frink stated that <br />there would be a joint session with the Planning Board this evening to discuss certain <br />SEQRA Procedures associated with this proposal. In attendance was Michele Grieg who <br />is the Planning Board's Environmental Consultant. She went on to state that the project <br />is an unlisted action under SEQRA. She does not feel that both the ZBA and Planning <br />Board should undertake separate SEQRA reviews. She also stated that in order for the <br />ZBA to make any type of determinations on the proposed variances - all SEQRA <br />Procedures unde~aken by them have to be closed. Therefore if the ZBA does decide to <br />declare its Intern to be Lead Agency - it would be asiother 30 days before the Board <br />could close SEQRA. Ms. Grieg felt that the best agency in this action to circulate for <br />SEQRA would be the Planning Board - with the ZBA being an Involved Agency. At this <br />point in the meeting Ms. Ruder made a motion to turn the meeting over to the Planning <br />Board, seconded by Mr. Frink. On roll call vote - Mr. Frink - Aye, Ms. Ruder - Aye, <br />Mr. Russell - Aye, Mr. Crawford - Aye, Mr. Kocan - Aye. <br /> <br />Mr. Morris, Chairman of the Planning Board spoke about the project. He stated that <br />some of the concerns of the Plmming Board were the applicant being granted his <br />variances, parking, increased traffic, buffering of lights and noise from the neighbors and <br />concerns of the neighbors regarding the employees of the house. Mr. Alfonso reminded <br />those in attendance that the Planning Board also acts as Architectural Review Board and <br />all future renditions of the existing and proposed buildings would have to be approved by <br />the Planning Board. He also stated that the ZBA should put any concerns they have <br />regarding this project in writing for the Planning Board's review. <br /> <br />At this point the meeting was turned over to the applicants. They stated that they are <br />trying to mitigate all problems that the neighbors have and are in discussion with them at <br />this time. They also went on to state that they are working on moving the parking to one <br /> <br /> <br />
