Lloyd Frinl;, Chair, Susan Ruder, Vice Chair, Newell Russell Absent: Mike Kocan and Dave Crawford Others Present: Catherine Doyle Yvette Walton Judy Morris Nicolette Hicks Philip Gu#ridge Dawns Chase Richard Swanson Meet~)tg was called to order at 7:30 p.m. At this point Mr. Frink made a motion to go into Executive Session to a2scuss pending litigation. Motion seconded by Mr. Russell. On roll call vote - Mr. Frink- Aye, Mr. Russell- A)v and Ms. Ruder- Aye. The Boardwas in Executive Session from 7:35p. m. to 7:45 p.m. When they returned to regular session it was stated that no action was taken chafing Executive Session. ~tjABITAT FOR HUMANITY~ $ DUTCHE$$ AVENUE First item on the agenda was the continuation of a public hearing on the request of Habitat for Humanity of Dutchess County seeking the following area variances to be able to have a single family house at 5 Dutchess Avenue which is in a R2.-F zone: (1) required lot width is 75 ff. and provided is 37 fl., (2) required lot area is 10,000 sq. ff. and provided is 6,771 sq. ft., and (3) required sidelines is 10 ft. and applicant cannot conform to the requirement, therefore the ZBA will have to make a sideline determination. Variances were previously approved at the July 9, 2002 meeting. At that time the ZBA determined the sideline would be - the west side yard setback would be up to and including two feet from the adjoining property line. Ms. Ruder stated when applicant left the previous meeting one of the requests from Mr. Russell was - if there was any change with Habitat being able to buy the adjacent property and Mr. Guttfidge stated them is no change - that situation is the same as it was a year ago - that he had contacted the bank that is in charge of the property and they stated that as long as there is pending litigation with the property no deal with the property would be able to be made. Applicant supplied the Board with their return receipt verifications. Mr. Viglotti stated for the record that up until January of 2003 he had volunteered services for Habitat but both he and Board did not feel this was a conflict in this hearing. Mr. Frink made a motion to close the public hearing - there was no second on the · motion - motion automatically failed. Ms. Ruder made a motion to keep the public hearing open, seconded by Mr. Russell. On roll call vote - Mr. Russell - Aye, Ms. Ruder-Aye and Mr. Frink - Nay. Mr. Kocan and Mr. Crawford -Absent.
