Motion seconded by Mr. Russell. <br /> On roll call vote - Mr. Frink- Aye, Mr. Russell- A)v and Ms. Ruder- Aye. <br /> The Boardwas in Executive Session from 7:35p. m. to 7:45 p.m. When they returned to <br /> regular session it was stated that no action was taken chafing Executive Session. <br /> ~tjABITAT FOR HUMANITY~ $ DUTCHE$$ AVENUE <br /> First item on the agenda was the continuation of a public hearing on the request of Habitat <br /> for Humanity of Dutchess County seeking the following area variances to be able to <br /> have a single family house at 5 Dutchess Avenue which is in a R2.-F zone: (1) <br /> required lot width is 75 ff. and provided is 37 fl., (2) required lot area is 10,000 sq. ff. <br /> and provided is 6,771 sq. ft., and (3) required sidelines is 10 ft. and applicant cannot <br /> conform to the requirement, therefore the ZBA will have to make a sideline <br /> determination. Variances were previously approved at the July 9, 2002 meeting. At <br /> that time the ZBA determined the sideline would be - the west side yard setback <br /> would be up to and including two feet from the adjoining property line. Ms. Ruder <br /> stated when applicant left the previous meeting one of the requests from Mr. Russell <br /> was - if there was any change with Habitat being able to buy the adjacent property <br /> and Mr. Guttfidge stated them is no change - that situation is the same as it was a <br /> year ago - that he had contacted the bank that is in charge of the property and they <br /> stated that as long as there is pending litigation with the property no deal with the <br /> property would be able to be made. <br /> <br /> Applicant supplied the Board with their return receipt verifications. Mr. Viglotti stated <br /> for the record that up until January of 2003 he had volunteered services for Habitat <br /> but both he and Board did not feel this was a conflict in this hearing. <br /> <br />Mr. Frink made a motion to close the public hearing - there was no second on the <br />· motion - motion automatically failed. Ms. Ruder made a motion to keep the public <br />hearing open, seconded by Mr. Russell. On roll call vote - Mr. Russell - Aye, Ms. <br />Ruder-Aye and Mr. Frink - Nay. Mr. Kocan and Mr. Crawford -Absent. <br /> <br /> <br />
