MINTUES OF ZONING BOARD OF APPEALS. M.EETING - 4/15/03 <br /> <br />Present: <br />Russell. <br /> <br />Absent: <br /> <br />Others Present: <br /> George Kolb <br /> <br />Lloyd Frink, Chairman, Susan Ruder, Vice Chair, Dave Crawford, Newell <br />Mike Kocan <br /> <br /> Judy Morris <br /> <br />Meeting was called to order at 7:30 p.m. It was noted for the record that there was no <br />Village attorney present for the meeting. <br /> <br />First order of business was to elect a new Chairman and Vice Chair. Ms. Ruder <br />nominated Mr. Frink to be Chairman, seconded by Mr. Crawford. Roll Call vote - Ms. <br />Ruder - Aye, Mr. Crawford - Aye, Mr. Russell - Aye, Mr. Frink - Abstain and Mr. <br />Kocan - Nay. <br /> <br />Mr. Fink nominated Ms. Ruder for Vice Chair, seconded by Mr. Russell - Roll call vote <br />- Mr. Frink - Aye, Mr. Crawford - Aye, Mr. Russell - Aye, Ms. Ruder - Abstain and <br />Mr. Kocan - Absent. <br /> <br />HUDSON VALLEY HOUSING FOR DIMARC, O .II <br />First on the agenda was the closed public hearing of Hudson Valley Housing with an area <br />variance to be able to have apartments 698 sq. ft. instead of the required 750 sq. ft. This <br />variance was granted previously but expired because applicant did not apply for her <br />building permit within the required 90 days~ It was stated that Mr. Kolb investigated the <br />matter and it is actually two lots - one that houses DiMarco I and one that will house <br />DiMarco II. Again it was stated that there will be no further development on either lot. <br />Ms. Ruder stated she sees this as a win/win situation. There are less units than actually <br />what the property could have and she feels this is a unique situation because the water <br />tower and easements are on the property. Mr. Frink made a motion to grant the variance, <br />contingent upon this project being the last development on the lot, seconded by Mr, <br />Russell. On roll call - Mr, Frink - Aye, Mr. Crawford - Nay, Ms. Ruder - Aye, Mr. <br />Russell - Aye. <br /> <br />MR. AND MRS. THOMAS SMITH, 34 MILL STREET <br />Next on the agenda was the closed public hearing of Mr. and Mrs. Thomas Smith, 34 <br />Mill Street to be able to have a second apartment in their home which is in a single family <br />zone. Mr. Russell stated they are being taxed as a two family house - they had the option <br />to grieve this at tax time and straighten it out. The applicants purchased the house as a <br />single family house - knowing it was a single family house in a single family zone. <br />There is nothing mfique with this parcel. Applicant must have a zoning hardship not a <br />personal hardship and they have not proven this. Also they did not try to sell their house <br /> <br /> <br />
