Minutes &pproved. <br /> <br />Chair-s- Savelli stated the first or, er of business en the agenda was a lmBlic hearing <br />requested By the Delehanty Funeral PIc~e (James F. X. & Xevin A. ) seeking a variance <br />to erect an acklition to the existing home and funeral hame located at 6~ East Main St. <br /> <br />Secretary read the N~tice of Appeal, Legal Notice as it appeared in the Southern <br />Dutchess News and the rece~znendati~n of the Dutchess County Dept. of Planning which <br />stated the decision on the matter pr~m;_~tly involves matters of local cOncern and <br />they rece~mended the decision be based upon local study of the facts in the case. <br /> <br />Chairman Savelli then asked Mr. Delehanty te present his case. <br /> <br />Mr. Delehanty shewe~ forms he had filled out amd a plan as to what he wanted to de. <br />BasicAlly nothing would be different and he will be 17 ft. frc~ the property line. <br />He said that he was told, legally, he only had to be 15 ft. fr~m the line. <br />Mr. Delehanty then introduced a letter fre~ Mm. & Mrs. Fre~ Cairo, ~ Maaier Avenue <br />North, stating they were in favor of the addition. <br /> <br />Atty. Lyons pointe~ ~ut that Mr. Delehanty had 15ft. in the front, 8 ft. on the side <br />an~ 25 ft. in the rear. Mr. Delehanty is 17 ft. fr~m Dr. Gol~m~'s property. <br /> <br />Chairman Savelli stated this a residential district. <br />Atty. Lyons peinte~ ~ut that the funeral h~ne, although established before zoning, is <br />a non-conforming use and therefore, an application for a variance is necessary if Mr. <br />Delehanty wants to enlarge the building. <br /> <br />Chairman Save]ii stated it was to Mr. Delehanty's advantage to enlarge the building. <br />He then stated that the variance could be granted with a ~aJority vote as the Dutchess <br />County Planning ~ept. ~id not recc~memd disapproval. <br />Atty. Lyons stated that if the Dutchess County Dept. of Planning had recm,,~ended dis- <br />approval of the variance request, in order for the variance to be granted, a majority <br />plus one veto is require~. <br />Chairman Savelli asked if there were any questions. <br /> <br /> <br />
