Naubennestel, ~ing Emforce~ent ~'ficer <br /> <br />Chairman Savelli c~lled the meeting to or,er 7:3~ p.m. <br />He requeste~L a motion to d~spense with the rea~ing of the ~inutes an~ to approve sa~e <br />as written an~ forwarded to ~11 me~bers by mail. <br />Motion by Mr. Ne,~-~ secca~le~ by Mr. Casey to dispense with the reading of the ~dnutes <br />a~d to ap-~ove same as written and fo~wam~ed to all ,~_ bors ~y mail. <br />All in favor; ~otion carried. Minutes approved as written. <br /> <br />Chairma~ Savelli stated there is a sign next to ~lly'8 which sa~s "c~aing Soon", BMA <br />Developers. He said that he ha~ received sc~e c~s in reg~ to same. It was ehec~e~ <br />into an~ f~mnd that Mr. Barton ha~ bought lmreperty fr~ Mr. Mierzw& an~ he is going to <br />enlarge his parking l~t. <br /> <br />Chairman Savelli stated that he ha~ receive~ many ca~ 1- in regar~L to the Getty Gas St&tion. <br />There are ~ unlicensed cars on the lot and it appears he is doing ~Jor repairs. The <br />property is becce~ing an eye sore. He asked the Colonel to check same, ~ut h_*_~_ hearA <br />nothing yet. <br />Mr. ,~m~th stated this should be checked very care~,~wy Before Jumping to a~f conclusions. <br /> <br />Atty. I~ons then discussed a change in the law in regard to Executive Session. Effective <br />i~aediate~, the Open Meetings Law, l~eed~a of Y~for~ation Law an~ Town & Village Laws <br />have been amended. He stated the Boar~ coul~ no longer go into Executive Session. For <br />yea~s, this di~ not &pply to "judicial or qu~si-Ju~icial proceediugs." l~men a public <br />hearing was hel~[ the Board could often ~eliverate in & closed session. This can no <br />longer be done. <br />Mr. Smith asked what would happen if tb~y did go into Executive Session. <br />Atty. ~ stated he is going to ~-~e a few c,.~a as he has a few i~ess he w~,~ ~e <br />to check out. <br />Mr. ~mith felt that if an executive session is ~pen, the people attending the public <br />hearing would -~o speak. <br />Atty. Lyons stated the Board could always adjourn as th~f have 60 ~s in which to mak~ <br />a decision. <br />Chairm~u Savel~ asked how they c~,]~ overc~e this matter. <br />Atty. Ifffons stated they can't. ~wever, he will check into it. He then gave the rea- <br />sons the ~ could go ~mto executive session: m*tters that wil~ i~peril public <br />safety if disclosed; matter which woul~ disclose the identity of & law enforcement agent <br />or infox~aer; information relating to current or future investigation or prosecution of <br />& cr~m~n~ offense which wamld imperil effective law enforcement if disclosed; discussions <br />regarding proposed, pending or c~rrent litigation; collective negotiations pursuant to <br />Article 1~ of civil service law; medical, financial, c~edit or emplo~nent history of a <br />particular person or corporation on matters le~ding to &ppointment, e~ployment, pra~o- <br />tion, demotion, disciples, suspension, dismissal or re, oval of & partic,,l~ person or <br />corpor&tion; the preparation, gredi~g or ~dministration of examinations; proposed ac- <br />quisition, sale or lc&se of real property or the proposed acquisition of securities, <br />or ss,lc or excb-.-~e of s~curities held by such public body, but only when publicity <br />would substa~t~a~]¥ affect the value thereof. <br /> <br />Discussion w~s then held by the Board in regard to public hearings. It was st&te~ they <br />often ~o not have the opportunity prior to the meeting to re~y study a matter that <br />is brought ~efore them. <br /> <br /> <br />
