<br />Chairman Savelli called the meeting to order 7:30 p.m.
<br />He requested a motion to dispense with the reading of the minutes and to approve same
<br />as written and forwarded to all members by mail.
<br />Motion by Mr. Casey, secQnded by Mr. Smith to dispense with the reading of the minutes
<br />and to approve same as written and forwarded to all members by mail.
<br />All in favor; motion carried. Minutes approved.

<br />Chairman Savelli stated that the first item on the agenda would be a public hearing
<br />at the request of William E. Karr & Thomas Clemens, 24 South Avenue, Village, appeal-
<br />ing, as persons aggrieved, decision of the Zoning Enforcement Officer, denying a re-
<br />quest to convert a single family dwelling located at 3 McCafferty Place, Village, into
<br />a two family home.
<br />Secretary read Notice of Appeal, Legal Notice as it appeared in the Southern Dutchess
<br />News; letter from County Planning which stated they have no authority to undertake
<br />a formal review: Village Planning Board feels that there is not enough evidence that
<br />it is a two family home and they were also concerned about square footage.

<br />Mr. Thomas Clemens addressed the Board. He said they filled out an application for
<br />a building permit to renovate and update the house. Ne said he was denied the permit
<br />to erect a two family, because it was felt that there was not enough information and
<br />evidence to grant same. He also stated that the notice In the paper was wrong. The
<br />Zoning Officer did not deny the building permit, the Planning Board did. Because it
<br />was the same family does net change the fact that it wasaa two family dwelling. There
<br />were separate bathrooms for each floor. The law states as long as the use is not dis-
<br />continued for 18 months, the use can be retained.
<br />Secretary then read letter, dated April 3rd, copy attached te original, minutes, addressed
<br />to Mr. Kart from the Zoning Enforcement Officer, stating a permit could not be granted.
<br />Mr. Clemens stated he and Mr. Kart were not denied permit by the Zoning Enforcement Officer.
<br />Zoning Enforcement Officer agreed with Mr. Clemens.
<br />Richard Cservak, 8 Seneca Lane, Wappingers Falls, stated he owns the 3 family opposite
<br />Mr. Karr's. He said he had an opportunity to buy the house and it was a two family.
