Y. <br />Harry Greco, Trustee <br />Phil Galioto, Fire Inspector, Village of Wappingers Falls <br /> <br />Chairman Savelll called the meeting to order 7:30 p.m. <br />He requested a motion to dispense with the reading of the minutes and to approve <br />same as written and forwarded to all members by mail. <br />Motion by Mt. Casey~ seconded by Mre VanWagenen to dispense with the reading of <br />the minutes and to approve same as written and forwarded to all members by mail. <br />All in favor; motion carried. Minutes approved. <br /> <br />Chairman Savelli stated that the first item on the agenda would be a public <br />hearing at the request of Frank & Antoinette Derasmo, 8 Dutchess Ave., Village <br />seeking a variance to subdivide his premises located at 6-8 Dutch,ss Ave., Village. <br />Variance is being requested due to the fact that there is a shortage of square <br />footage. <br />Secretary read the Notice of Appeal, the legal notice as it appeared in :he <br />~uthern Dutch,ss News and the recommendation from the Dutchess County Dept. of <br />Planning which stated that the matter and decision should be based upon local <br />study of facts in the case. <br />Chairman asked if all within 200 feet had been notified and secretary replied yes. <br />Atty. Ken Stenger, who was filling in for Village Attorney Viglotti, swore Mr. <br />Derasmo in. <br />Mr. Derasmo stated that he appeared before the Planning Board and they had no <br />objection. They could not permit the subdivision due to the shortage of square <br />feet. He stated that he wanted to sell the side of the house with the two <br />apartments. The house was there prior to zoning. He will not be changing <br />anything. Now there w/ll be two deeds. Parking is adequate. <br />Chairman Sauelll asked if at~jone had any questions. <br />Mr. VanWsgenen, for clarification, stated that Mr. Derasmo would be selling the <br />two family side and he would keep the other side for himself. <br />Mr. Derasmo stated that this was correct. <br />Mr. VanWagenen stated that there is 80 ft. less than is required. <br />Discussion was held on lot size and parking. <br />Mr. Breglia asked if both sides had a driveway. <br />Mr. Smith questioned if this would come under the fire code. <br />Mr. Galioto stated that 717 of the fire code stated that there must be a fire <br />wall on both sides. <br />Mr. Smith asked ff this could be sheet rock. <br />Mr. Derasmo stated that there is a brick wall in the basement. <br />Mr. Galioto, Fire Inspector, stated that according to section 717 of the fire <br />code~ a fire wall had to be from the basement to the ceiling. <br /> <br /> <br />
