Appeals cannot legally be held due to the <br />fact that Legal Notices did not appear in the SDN for a full 10 days and therefore <br />decisions cannot be made because their legality could be Questioned All applicants were <br />notified and told that their aopeals would all be heard the following month. <br />The minutes were passed as written by Sterling VanWagenen and George Casey. <br /> <br />At 7:33 p.m., Attorney Cantor a~oeared informally to discuss the DeSantis-DeMilis <br />property at 32 High St, Vlllage. The property originally had two separate deeds <br />~and was made into one deeded piece for unknown reasons years ago. The property <br />measures 82½ feet x 340 ftx 260 ft x 96 ft. They would like to subdivide into 2 <br />separate lots. It is an R 7.5 district and all other requirements are met except <br />for slde line requirements. A variance would have to be obtained. They appeared <br />before fha Planning Board last year informally. There is no reguirement in the <br />Zoning Ordinance for frontage -- average horizontal distance -- therefore there <br />can be an average width of 50 feet. A map was shown and it was explained that it is <br />possible to lay out land to meet the average requirements. A 50 foot frontage rs. <br />a 50 foot average width needs clarification by the Board. <br />Attorney Cantor would llke to "privately kick thls around'~ at the Board's and the <br />attorney's discretion. <br />Frank Savelli suggested that they get a legitimate survey showing exactly how they <br />want the property subdivided. Going from 2 deeds to 1 deed for a bank loan in t984 <br />promotes confusion in 1987. The ZBA will, however, cooperate in any way it can, <br />since the land should be utilized. <br />Sterling VanWagenen added that side yard drainage and off street parking with an <br />easement in the back should be worked into the presentation. This in turn should <br />go before the Planning Board. The map ~as left for the files. <br /> <br />At 7:45 p.m., there was an informal discussion.
