Frank Savelli, Chairman: Rudy Rreglia; George Casey; Robert Smith~ <br />Kathleen Wilson, Secretary: Louis Viglotti, Village Attorney. <br /> <br /> AIso present: <br />Phil Galtoto, Code Enforcement Officer <br />Joe Casey, 17 Prospect St, W.F. <br />Ron Relyea, 19 Prospect ST, W.F. <br />Jo Relyea, 19 Prospect St, W.F. <br />Gall Weitlich, 22 Prospect St, <br />Alan Weitllch, 22 Prospect St, W.F. <br />Diane O'Laary,Sunset Crest Realty Attorney <br />Kathleen Italiano, 23C West Main St, W.F. <br />Lou Snell, 19 Monroe Drive, Pok. <br /> <br />The meeting was called to order at 7:31 p.m. The minutes were not read at the meeting <br />with a motion to abstain made by Robert Smlth and seconded by Rudy Breglia. <br /> <br /> The first item on the agenda was an aopearance by Joseph Casey who is seeking a <br />side line variance for his property located at 17 Prospect St. The Secretary read <br />the appeal <br />Mr. Ron Relyea of 19 Prospect St spoke and stated that he wants enforced side line <br />privacy slnce the dSek in question is already built and he does not like the thought <br />of ripping it down. The deck comes within 2 feet and 1 foot of his side line property <br />line. He presented before and after pictures and a survey map to show that the new <br />addition is significantly larger than the old stairway. Mr. Casey had an addition <br />put on 15 years ago and with the additon of such a laroe deck, his next door neighbors <br />feel that their privacy is infringed uOon, <br />Mr. Casey was asked why he ~[e~drf~.~ large deck and told the Board that the <br />carpenter built ~t the way neAwanTe~lto <br />A modesty fence wa~ discussed but it would not help the Relyea~s who also feel that <br />Mr Casey did not build the deck with the benefi~ of a building permit in the first place, <br />Mr. Casey stated that he did not realize that he needed a B.P. for something that he <br />tore down and replaced. <br />Discussion of the choices concerning the deck: <br />1) ripping it down - which neither party would feel comfortable doing <br />2) Mr Casey paying for some over, caen trees to give Mr Relyea the privacy buffer that <br />he needs <br />Mr. Viglotti would like to see the issue resolved between the parties. <br />Executive sesslOn~ 8~00 pom. to 8:05 pm. <br />There will be a continuation of the hearing at the next meeting with the two neighbors <br />coming uD with acceptable alternatives. <br /> <br />At 8~06 pm 90~ay variances were extended for Community Services. Motion by Robert <br />Smith, secon~l.~l by George Casey and abstained by Rudy Breglia. New expiration date <br />November 5, 1987. <br />William J, Eagen's variance was extended with a new expiration date of November 5, 1987 <br />Motion made by Rudy Breglla, seconded by George Casey. All Ayes. <br /> <br />At 8:10 p.m.~Dlane O'Leary of ~uernsey, Butts & Walsh who represents Mr Klebe~ owner <br />of 6-12 Mill S~. Mr. Vlglotti asked for floor plans of each floor to determine <br />parking reouirements in this continuation of the interpretation of the Zonin~ Ordinance <br />Structure and land use needs to be taken into consideration regarding parking. <br />Ms. O'Leary stated that if the proposed new use requires a 25% increase In parking. <br />you do not have to increase the parking space according to our Zoning Law . <br /> <br /> <br />
