Upon motion <br />by Mr. Casey, Seconded by Mr. Smith, minutes of meeting held <br />December 8, 1987 were approved as written and received by all <br />members by mail. Motion unanimously carried. <br /> <br />LOUIS SNELL, 51 MARKET STREET, WA~PINGERS FALLS <br /> <br />Chairman advised the first order of business would be public hearing <br />on request of Louis Snell, 19 Monroe Drive, Poughkeepsie, seeking a <br />variance for property located at 51 Market Street, Wappingers Falls. <br /> <br />Secretary read Legal Notice as inserted in Southern Dutchess News, <br />and Notice of Appeal #25-87. <br /> <br />Mr. Snell stated that he desires to subdivide his property and <br />appeared before the Planning Board December 3, 1987. The Planning <br />Board recommended that he furnish a map showing the subdivision of <br />the property which falls into two different zones and request an <br />appearance before the Zoning Board of Appeals for a variance. Mr. <br />Snell presented a map showing the square footage of each lot as it <br />would appear after a subdivision. He explained that in his previous <br />appearance before this Board, he advised that he wished to divide <br />the area along the cliff which he pointed out on the map. However, <br />this would give an area less than 10,000 square feet (minimum lot <br />size). Therefore, the new proposal would give a 10,000 square foot <br />lot size. He further explained that the variance is requested be- <br />cause the width of the property is 60 feet instead of the required <br />75. <br /> <br />Samuel Iannone addressed the Board advising that he has been at the <br />bleachery property since 1962, at which time he purchased a three- <br />story building. He advised that there is a difference of opinion as <br />to the right of way he has. Mr. Snell believes it is 15 feet, Mr. <br />Iannone said, and they have had a 35-foot right of way since 1962. <br />Mr. Iannone stated that Mr. Snell has a land-locked piece of land and <br />in order to get to it, he must go over Mr. Iannone's encroachment which <br />they have used since 1962. <br /> <br /> <br />
