MINUTES OF REGULAR MEETING OF THE ZONING BOARD OF APPEALS
HELD AT MESIER HOMESTEAD, WAPPINGERS FALLS, - APRIL 12, 1988

Present:

Chairman Frank Savelli, George Casey, Sterling Van-
Wagenen, Robert Smith, George Kolb, Deputy Zoning
Enforcement Officer Anthony Pacio, Secretary Peggy
Fasciani. Absent: Village Attorney Louis Viglotti

Others Present:
Ann Pulling, 16 North Remsen Avenue, Wappingers Falls
Keeler Pulling, 16 North Remsen Avenue, Wappingers Falls
Roger Ciarfella, 4 Pelham Place, Wappingers Falls

Meeting was called to order by Chairman Savelli at 7:30 P.M.
Motion was made by Mr. Casey, seconded by Mr. VanWagenen that
minutes of meeting held March 8, 1988 be approved as written
and received by all members by mail. Unanimously carried.

The board welcomed George Kolb as a new member of the Zoning
Board of Appeals to replace Kenneth Kane.

ANN AND KEELER PULLING, 16 NORTH REMSEN AVENUE

Chairman stated first order of business would be holding of public
hearing on request of Ann and Keeler Pulling, 16 North Remsen
Avenue, Village, seeking an area variance to allow the construc-
tion of two-car garage on the rear of their property at 16 North
Remsen Avenue.

Chairman pointed out that the public hearing, originally scheduled
for April 5, was postponed to April 12 because of a lack of quorum.
All those present on April 5 were advised of the postponed date.

Secretary read the Notice of Appeal 92-88 and the legal notice
as inserted in the March 23, 1988 edition of Southern Dutchess
News. She advised that all property owners within a distance of
200 feet from the subject property had been sent copy of legal
notice.

Mr. Keeler stated that he is in need of a two-foot setback variance
because of the contour of the land. The elevation difference at
the rear of the property is too great to allow the building of a
garage in the center of the property.

When Mr. VanWagenen questioned why he needed a setback when the
plan showed he had 20 feet, Mr. Keeler advised that the house is
not truly rectangular as shown on sketch and has several jogs in
it. After further discussion, Mr. Pacio, deputy zoning enforcement
officer, confirmed that Mr. Keeler would have to make a wide swing
in order to get into the garage and Mr. Pacio felt Mr. Keeler was
not asking for too much of a variance because of the contour of
the land.
