MINUTES OF SPECIAL MEETING OF THE ZONING BOARD OF APPEALS HELD AT MESIER <br />HOMESTEAD~ WAPPINGERS FALLS~ NEW YORK - SEPTEMBER 20~ 1988 <br /> <br />Present: <br /> <br />Chairman Frank Savelli, George Casey, Robert Smith, Sterling <br />Van Wagenen, George Ko lb, Village Attorney Viglotti and Mary Ann <br />Wood, Secretary. <br /> <br />Others Present: <br /> Trustee Harry Greco <br /> Deputy Zoning Enforcement Officer Tony Pacio <br /> Planning Board Chairman Tom Visentin <br /> Mr. & Mrs. Raymond Marshall, 8 Clapp Avenue, Wappingers Falls <br /> <br />Meeting was called to order at 7:30 p.m. by Chairman Savelli. <br /> <br />BARBARA MARSHALL~ 8 CLAPP AVENUE~ WAPPINGERS FALLS, NEW YORK 12590 <br />Chairman Savelli stated that the only order of business would be holding <br />of public hearing on application of Barbara Marshall, 8 Clapp Avenue, <br />Wappingers Falls, New York, seeking a variance from Section 542.5 to be able <br />to convert her tavern into apartments. Secretary read legal notice as inserted <br />in the September 7, 1988 edition of Southern Dutchess News, and notice of <br />Appeal #13-88. Secretary stated that the Dutchess County Planning Depart- <br />ment did not respond to the zoning referral. <br /> <br />Chairman Savelli passed around the plans for the proposed apartments that <br />have been approved by a licensed engineer. <br /> <br />Mr. Marshall stated that he wanted to put in 4 good-sl'zed apartments and <br />Chairman Savelli asked if there was ample parking. Mr. Marshall responded <br />that there was. <br /> <br />Mr. Pacio stated that as far as he and Colonel Haubennestel were concerned <br />this would be a plus for the area and the community as a whole. <br /> <br />Mrs. Marshall stated that each of the four apartments would have their own <br />entrance, therefore avoiding confusion with the apartments that are already <br />there. <br /> <br />Secretary read a letter from Planning Board Chairman Visentin stating that <br />the Planning Board, while finding this to be a desirable project, cannot give <br />immediate approval due to the non-conformance of the plans to the existing <br />Zoning Ordinance. The Planning Board recommended that Mr. & Mrs. Marshall <br />go to the Zoning Board of Appeals for a variance which would allow a multiple <br />family dwelling in an R2F zone. <br /> <br />Mr. Viglotti asked how long the other apartments in the residence have been <br />there? Mrs. Marshal answered they were there when she purchased the building. <br /> <br /> <br />
