MINUTES OF REGULAR MEETING Of THE ZONING BOARD OF APPEALS HELD AT MESIER <br />HOMESTEAD~ WAPPINGERS FALLS, NEW YORK - JANUARY 3~ 1989 <br /> <br />Present: <br /> Mr. Bob Smith, Acting Chairman, Sterling Van Wagenen, George Kolb, George <br /> Casey, Village Attorney Lou Viglotti and Mary Ann Wood, Secretary. <br /> <br />Others Present: <br /> Tony Pacio, Zoning Enforcement Officer <br /> Tom Visentin, Chairman Planning Board <br /> Vincent S. Francese, ll Reservoir Terrace, Wappingers Falls <br /> Mr. and Mrs. William Utter, RD8, Box 75, Hopewell Junction, NY <br /> Steven Tinkelman, llO Mill Street, Poughkeepsie, NY <br /> Hank DiMarco, Pleasant Lane, Wappingers Falls, NY <br /> <br />Meeting was called to order at 7:32 p.m. by Acting Chairman Smith. Motion was <br />made by George Kolb and seconded by Mr. Van Wagenen that minutes of meeting held <br />December 6, 1988 and received by all members by mail be approved as written. <br />Unanimously carried. <br /> <br />MR. VINCENT FRANCESE, ll RESERVOIR TERRACE, WAPPINGERS FALLS <br />Acting Chairman Smith stated that the first order of business would be holding' <br />of public hearing on application of Mr. Vincent Francese, ll Reservoir Terrace, <br />Wappingers Falls seeking a variance from the minimum yard requirements of the <br />Schedule of Regulations for residential district of the Village of Wappingers <br />Falls. Secretary read legal notice as inserted in the December 21, 1988'edition <br />of Southern Dutchess News and Notice of Appeal #22-88. Secretary advised that <br />all property owners within a radius of 200 feet from subject property were fur- <br />nished a copy of the legal notice and Dutchess County Department of Planning <br />responded to the zoning referral and indicated they had no problems with it. <br /> <br />Secretary read a lelter from Mrs~ Fred Williams, 9 Reservoir Terrace, Wappingers <br />Falls indicating she wholeheartedly endorsed granting the variance soug~t by Mr. <br />Francese to build proper livingquarters for his disabled daughter. <br /> <br />Mr. Francese stated he has a 26 year old daughter who is suffering from MS. she <br />needs quite a bit of care but she still wants to maintain some of her own inde- <br />pendence. For this reason Mr. Francese wants to build an addition on to his <br />present premises which would be a separate apartment for his daughter. He stated <br />that he has been working with Dutchess County Department of Planning for t~is <br />addition and indicated that Dutchess County Department of Planning paid to have <br />the plans for this addition drawnup. Mr. Francese passed around a. copy of the <br />plans for the Board to see. The apartment is set up for a. handicapped person <br />to use with bars around the rooms and ramps for wheelchairs. <br /> <br />An informal discussion followed with no one objecting to Mr. Francese's appli- <br />cation. Mr. Kolb made a motion to grant Mr. Francese a variance from the 25 <br />feet rear yard setback. Mr. Van Wagenen seconded the motion. Motion was <br />unanimously approved by roll call vote - Mr. Smith, Y~s, Mr. Kolb, Yes- Mr. <br />Casey, Yes and Mr. Van Wagenen Yes. Mr. Viglotti informed Mr. Francese that <br />he had 90 days to obtain a permit. If he needed more time, he was to ask for <br />an extension. <br /> <br /> <br />
