MINUTES OF REGULAR MEETING OF THE ZONING BOARD OF APPEALS HELD AT MESIER <br />HOMESTEAD, WAPPINGERS FALLS, NEW YORK - MARCH 7, 1989 <br /> <br />Present: <br /> Mr. Frank Savelli, Chairman, Robert Smith, George Casey, George Kolb, <br /> Sterling Van Wagenen, Village Attorney Viglotti and Mary Ann Wood, <br /> Secretary. <br /> <br />Others Present: <br /> Harold Reilly, Esquire, 107 East Main Street, Wappingers Falls <br /> Mr. and Mrs. Joseph Johnson, 19 Franklindale Avenue, Wappingers Falls <br /> Eileen Masterson, 60 Mesier Avenue South, Wappingers Falls <br /> <br />Meeting was called to order at 7:30 p.m. Motion was made by George Casey and <br />seconded by Sterling Van Wagenen that minutes of meeting held February 7, 1989 <br />and received by all members by mail be approved as written. Unanimously carried. <br /> <br />MR. FELIX LOPEZ, 3 ELM STREET, WAPPINGERS FALLS, NEWYORK <br />Chairman Savelli stated that the first order of business would be holding of public <br />hearing on the application of Mr. Felix Lopez, 3 Elm Street, Wappingers Falls, New <br />York 12590 seeking a variance to permit the erection of an addition to a legal <br />non-conforming structure in a R7.5 district. Secretary read legal notice as in- <br />serted in the February 22, 1989 edition of the Southern Dutchess News and Notice <br />of Appeal #2-89. Secretary.advised that all property owners within a radius of <br />200 feet from subject property were furnished a copy of the legal notice and <br />Dutchess County Department of Planning responded that they did not have enough <br />information to respond to the zoning referral. <br /> <br />Secretary read a letter from Mr. and Mrs. Newton Erickson who own property at <br />21-23 Franklindale Avenue that connects with that of the applicant stating <br />that they can see no way that the proposed addition would affect their pro- <br />perty and that they understand that this addition would be added non-confor- <br />ming space to a structure that is under a non-conforming variance. <br /> <br />Mr. Harold Reilly, attorney for Mr. Lopez stated that the applicant has been <br />renting the premises to a corporation known as E.G. Snyder Co., Inc. This <br />corporation uses the premises for storage and office space. The numbers of its <br />staff is fixed and it is the type of business that generates little or no traffic. <br />Recently, the tenant advised the applicant that they are in need of additional <br />space and unless the applicant is able to provide them with this space they in- <br />tend to vacate the premises. <br /> <br />Secretary passed around a copy of the proposed plan. Mrs. Mary Johnson stated <br />that she owns property that abuts with Mr. Lopez's property. She is planning <br />to put a house on that property for her daughter and she is against Mr. Lopez's <br />proposed addition. <br /> <br />An informal discussion followed and Mr. Reilly stated thathe thought the hearing <br />should be adjourned until Mr. Lopez could come up with an engineer's plot plan <br />showing the exact dimensions of the structure and proposed addition. <br /> <br /> <br />
