MINUTES OF REGULAR MEETING OF THE ZONING BOARD OF APPEALS HELD AT MESIER HOMESTEAD <br />WAPPINGERS FALLS~ NEW YORK - JUNE 6, 1989 <br /> <br />Present: Mr. Frank Savelli, Chairman, Robert Smith, Sterling Van Wagenen, Harry <br /> Greco, George Casey, Mary Ann Wood, Secretary. <br /> <br />Others Present: <br /> Mary Johnson, 19 Franklindale Avenue <br /> Patricia Fischer, 138 Stormville Road, Hopewell Junction, NY <br /> Harold Reilly, 14 Mesier Avenue South <br /> Felix Lopez, 3 Elm Street <br /> Jeff Contelmo, Route 9D, Hughsonville <br /> John Christie <br /> Dick Barger <br /> <br />Meeting was called to order at 7:30. Motion was made by Robert Smith, seconded <br />by George Casey to accept the minutes of the May 2, I989 meeting. Unanimously <br />carried. <br /> <br />MR. FELIX LOPEZ, 3 ELM STREET, WAPPINGERS FALLS, NEW YORK 12590 <br /> <br />Chairman Savelli stated the first order of business would be continuation of <br />public hearing originally held March 7, 1989 seeking a variance to permit the <br />erection of an addition to a legal non-conforming structure in a R2-F zone. <br /> <br />Mr. Contelmo presented a plan of a proposed front elevation for the addition <br />that Mr. Lopez is requesting. Mr. Savelli asked how many feet from the road the <br />proposed addition would be and Mr. Contelmo answered 20 feet. Mr. Contelmo stated <br />that according to the Zoning Ordinance, Mr. Lopez has adequate parking for his <br />property. <br /> <br />Patricia Fischer who owns the property alongside Mr. Lopez's was concerned <br />about the increase of traffic. Mr. Reilly explained there would be no increase <br />in traffic. There would be no more employees hired and they do not plan to <br />increase or expand the business. <br /> <br />Mr. Visentin stated if Mr. Lopex does lose his tenant he could get a new tenant <br />that has a lot more traffic. <br /> <br />Executive Session 7:55 to 8:10. <br /> <br />Mr. Van Wagenen made a motion that the application for the variance be denied. <br />It is the opinion of the board that they have helped Mr. Lopez out several times <br />before in his applications for variances. There is no hardship in this issue. <br />Further expansion of this building will not be in the best interest of the village. <br />Seconded by Mr. Smith. Unanimously carried. <br /> <br /> <br />
