MINUTES OF ZONING BOARD OF APPEALS MEETING <br /> <br />HELD SEPTEMBER lO~ 199] <br /> <br />Present: Frank Savelli, Mitchell Usavich, Sterling Van Wagenen, Harry Greco, Robert Smith and Mary <br /> Ann Bolander, Secretary <br /> <br />Others Present: <br /> Eileen Masterson <br /> Ray Dabrymap le <br /> Linda Vigar's <br /> Peter Emmi <br /> Mr. and Mrs. J. Klebe <br /> Peg O'Leary <br /> <br />Meeting was called to order at 9:35 p.m. Motion by Mr. <br />Van Wagenen, seconded by Mc. Usavich to accept tile minutes <br />of the August meeting received by all member by mail. <br />Unanimously carried. <br /> <br />LINDA VISARS~ ~3 PROSPECT STREET~ WAPPINSERS FALLS <br />First on the agenda was the application of Ms. Linda Vigacs, <br />~3 Prospect Street seeking a variance to be able to construct <br />a deck less than 5 'Feet fr'om the required side line setback. <br />Secretary read legal notice which appeared in the Southern <br />Dutchess News and Notice of Appeal. Secretary also informed <br />that property owners within a ~00 ft. radius had received a <br />copy of the legal notice and Dutchees County Department of <br />Planning had responded to the zoning referral with a "matter <br />of local concern" comment. <br /> <br />Mrs. Vigars stated she would like to comstruct a two <br />level deck but because of current conditions she cannot <br />adhere to the necessary side line setback. Mr. Greco <br />suggested she could break up the current patio and put the <br />footings within the concrete slab meeting the required <br />depth (48") that is required by New York State Code so there <br />is no overhang. Mrs. Vigars stated she would r'ather not <br />do this. <br /> <br />After much discussion Mr. Greco made a motion to grant the <br />area variance for a two level deck but no point of the <br />structure is to be constructed any closer to the line than <br />the existing patio and screen house. Mr. Savelli also stated <br />that ~he deck is not to be closed in. Motion seconded by Mr. <br />Usavich. On roll call vote - Mr. Smith - Aye, Mc. Van <br />Wagenen - Aye, Mr. Greco ....
