Unanimously carried. <br /> <br />First on the a~enda was the continuation of a public hearin~ <br />on behalf of A.M. K~nnedy Truckin~ seekin~ a variance to be <br />able to rebuild his buildi~ at 17 ~alton Street. Mr. Smith <br />stated that it had been 6 mont~ since their last appearance <br />and when they appeared last month it was only an informal <br />appearance. <br /> <br />Mr. Mangold presented case for Mr. Van Voorhis. He stated <br />that on May 11, ]993 a public hearin~ was o~ened under <br />Section ~65 of Zoning Code. ~ prior court action, <br />"Sett/ement of Stipulation" presented to this Boa~ and <br />si~ed on J~uary 10, ]990 stated (1) a.M. Kennedy and/or Mid <br />Hudson Moving a~d Storage is a non-conforming use in a <br />residential zone and (2) the use shall "run with the land." <br />Pr/or t~stimo~¥ statms t~at on March 13, 1993 a stox~ <br />part~ally d~ged building. F~-. Walt Finnea~man a licensed <br />real est~t.e appmaiser was SWol-n in at the May meeting and <br />stated t~at prior to damage the fair market value of 17 <br />Fulton Stl~et was $175,000.00; $5§,000.00 for land and <br />$120,000.00 for building. <br /> <br />Next Mr. Ray V~ Voorhis, ~I~ was swol-n in and stated that <br />the percentage of loss of buildln~ is 37~ which is less than <br />the 50~ stipulated by Section ~65. He also stated that the <br />restoration cost is about 88.6% of the replacement value of <br />the destroyed portion and the replacement value is ~8.9~ of <br />the fair market value of the building before the day, age. <br />Mr. Van ~oorhis stated the way he arrived at his figures was <br />from pictua-es, Mi-. Finnerman's letter, past experience and an <br />architect's handt~ok that is used in his office. Xt was also <br />stated that if permission was granted to be able to rebuild <br />new building would be built on less of a footprint, would <br />only be 1~ ~t. in height; would be pl~perly landscaped, <br />aesthetically it would be done in eart~tones and would meet <br />ail fire and building codes.
