Unan~usl y carried. <br /> <br />First on ~he ~enda w~ the applicatioR of <br />83 East ~in Street seeki~ a variance to ~ able to b~aild <br />closer ~o sideline ~han the 2'8" variance he had received <br />previously. Se~e~a~ ~ad legal no%i~ and s~ated all <br />pro~y o~ers within a 200 ft. radi~s ~d k~en f~ished a <br />copy of the lesal notice. Se~ta~ also infomd t~t <br />~tchess County Depa~ment of Pl~nir~ ~d not res~nded to <br />the zoni~ refe~al. <br /> <br />Mr. Day pl~sent.ed the case for Dr. Manasar. He stat.ed Dr. <br />Manasar had deviated from plans without the knowledge of <br />archit.ect. He had put in a full basen~nt and side entrance <br />on outside of cellal~ay. He had encl~ached upon t~]e variance <br />he had originally received for a 2'8" sideline. <br /> <br />Mi'. Greed asked MI-. DiMarco who is t~e pl~3~l-ty o~er <br />immediat.ely next door what his feeling was and MI-. DiMarco <br />stated if he had been asked l~fore f_he work was c¢~plete he <br />would have l~commanded to Dr. Manasar he follow t~e pl~per <br />pl~cedures but since it is now built he has no objection as <br />long as it d¢-~s not encl~ach on his property. <br /> <br />MI-. Lewis qx~estioned how t~e fk~al~ can st~p Dr. Manasar from <br />doing what he wants t~ do witl]out followin~ pl~per <br />procedures. Mr. Lewis also stated t~le fault also lies with <br />the centrac~3r who did not follow the architectural drawings. <br /> <br />Mr. Patio stated for t~e reco~ that Dr. Manasar has done <br />exactly what he wanted wit~ no regard for approved plans. <br /> <br />MI-. Greed made a n~tion to deny variance based on t~]e fact <br />that DI-. Manasar knewinEly changed t~]e pla~]s without <br />following proper pl~,cedul~es. MI-. G~co also stated he felt <br />the c. onta'actor was remis in not following archit.ectural <br />drawings. Motion seconded by MI-. Lewis. On roll call vote <br /> <br /> <br />
