MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 2/10/98 <br /> <br />Present: Bob Smith, Bob Lewis, Sue Hodge, Floyd Hood and Mary Ann Bolander <br /> <br />Absent: Harry Greco <br /> <br />Others Present: <br /> Del Scheure - IONA Pools <br /> <br />Meeting was called to order at 7:33 p.m. Motion by Mr. Hood seconded by Mr. Lewis to <br />approve the minutes of the previous meeting which were received by ail members. Unanimously <br />carried <br /> <br />IONA POOLS, PATIOS, SHEDS AND SPAS FOR PROPERTYATRT. 9 & OLD RT. 9 <br />First on the agenda was the application of lONA Pools, Patios, Sheds and Spas seeking a <br />variance to be able to erect a fence around a display higher than the allowed 6ft. at the <br />above address. Secretary read legal notice and stated that it had beenpublished in the <br />Southern Dutchess News. Applicant presented the board his receipts from the certified mailing <br />he was required to do. Dutchess County Department of Planning responded to our zoning re- <br />ferrai with a letter dated February 9, 1998 stating "To comply with the variance request and <br />still make a better appearance for the site, The Board could consider, as an alternative to a <br />9fi. chain link fence, a modern version of a cast iron fence with supplemental landscaping." <br />They also stated that the Board shouM rely on its own study of the facts but keep in mind the <br />County's recommendation. <br /> <br />Applicant stated they would like to erect a display of their pools, spas, and sheds on the corner <br />of Rt. 9 and Old Rt. 9 (adjacent to Pizza Hut). It would be a temporary display - only there <br />for about 7 months. He stated that the sheds are being provided by Mr. Shed who is going in <br />half with him on the rental of the property. Applicant presented the Board with a letter from the <br />owner of the property giving his permission for the applicant to act in his behalf. He went on to <br />say that the 9fi. fence is a requirement of his insurance company. He needs' it for obvious <br />security reasons. He stated that he will use one of the sheds on site for his office and that he will <br />be using Pizza Hut's restrooms. Last year when they had a similar display they used round the <br />clock security and it was very costly. Mrs. Hodge explained to the applicant that the job of the <br />ZBA is to grant the minimal relief possible for an area variance and asked if there was any <br />documentation from the insurance company stating a 9ft. fence is required. Applicant stated <br />insurance will not accept anything less than a 8fl. security fence with l ft. of barbed wire on <br />top. <br /> <br />Mr. Hood asked if they could go with a 7fi. fence with l ft. of barbed wire instead of the 8fl. <br />fence and applicant stated he would have to check with the insurance company. Mrs. Hodge <br />stated she feels the Board cannot ignore the County's comments and asked applicant to bring <br />documentation comparing the cost of a chain link fence versus cast iron. Again Mrs. Hodge <br />reminded applicant that the ZBA must go with the minimal relief possible. Applicant explained <br />that the pools will be filled- water being trucked in.
