On roll call vote - Mr. Hood- Aye, Mr. Greco - Aye, Mr. Lewis - Aye, Ms. Hodge <br />- Abstain (Absent from Augntst meeting) and Mr. Frink- Absent. <br /> <br />JOHNSON FAMILY HOUSEt 63 IVEST MAIN STREET <br />First on the agenda was a discussion regarding the above granted variances. Mr. Hood <br />stated that the ZBA had received a letter from Deputy Mayor Goebel asking that the ZBA <br />reconsider their decision on the variances and rehear the case because of the public <br />controversy surrounding this decisiort (A copy of this letter is on file in the <br />Planning/Zoning office). Ms. Hodge asked in terms of considering a rehearing there <br />needs to be a substantial change of fact, evidence or condition to warrant such an action <br />- would letters from 86 residents warrant a rehearing? <br /> <br />Mr. Viglotti stated that our code allows the ZB~I if they believe there has been a change <br />in circumstances or a presentation that was not in harmony with the facts and those facts <br />are now found to be inaccurate than you have cause for a rehearing. He went on to state <br />that the ZBA must review the records and determine if circumstances have changed in <br />order to rehear the case. <br /> <br />Mr. Hood stated he had wrote a letter to the Board of Trustees dated 9/8/98. (A copy of <br />this letter is on file in the Planning/Zoning office). The first claim that the site lacks the <br />minimum area for the required zoning is the reason a variance was requested.
