AND MRS. STEVE BARRY FOR 62 WEST MAIN STREET <br />First on the agenda was the application of Mr. and Mrs. Steve Barry, 112 South Avenue <br />seeking three area variances to be able to have three families at 62 West Main Street <br />which is located in a RM-1 zone. These variances are as follows: (l) minimum lot area - <br />required is 12, 000 sq. fi. and provided is 9,500 sq. fl., (2) front setback- required is 15fi. <br />and provided is Oft. and (3) south side setback- required is 15 fi. and provided is 12 fi. <br />Mrs. Barry presented her affidavit of publication from the January 25, 1999 edition of the <br />Poughkeepsie Journal. It was also noted that Dutchess County Department of Planning <br />responded to the zoning referral with a matter of local concern comment. <br /> <br />Mrs. Hodge read a letter from Planning Board Chairman Visentin dated January 21, <br />1999 stating that the applicants have appeared before the Planning Board and the <br />Planning Board has noted the required area variances. The Planning Board has no <br />objection to the variances being granted <br /> <br />Mr. Barry stated the space where he is asking for the third apartment used to be a <br />storefront but it lost its non-conformity because it was not used for 18 months. Mrs. <br />Hodge asked applicant when they purchased the building and he said in October of 1998. <br />Mrs. Hodge then asked applicant if when they purchased the property he was aware <br />there was a storefront there. He stated when he bought the property the storefront was <br />closed and it had lost its grandfather clause. He would have to go to the ZBA for a <br />variance to be able to use it as a storefront agair~ He chose to convert to an apartment, <br />which is an allowed use. <br /> <br />~4pplicant stated there will be no structural differences to the building. The sizes of the <br />apartments are 804 sq. fi. for the new one, and the existing ones are 804 sq. ft. and ll00 <br />sq. fi. There is adequate parking for approximately 12-14 cars. Mr. Frink asked <br />applicant if he had tenants in the two present apartments and he answered yes he did. <br /> <br />Mrs. Hodge stated that one of the things the ZBA needs to da when deciding on an area <br />variance is benefit to the applicant vs. detriment to the community. In the applicants' <br />application he stated that he could not afford to run the building but yet he bought the <br />building knowing it had been a storefront.
