MINUTES OF ZONING BOARD OFAPPEALS MEETING HELD 5/11/99 Present: Sue Hodge, Chairperson, Harry Greco, Bob Morris, Bob Lewis Absent: Lloyd Frink Others Present: Cindy Latino Paul Pilon Peg 0 Zeary Trustee Hinzmann George Crowder Paul Latino Betty Miceli Stan Straub Armand Alfonso Rev. Hunt Meeting was called to order at 7:32 p.m. Roll call was taken. Mr. Frink absent. CINDY LA TINO DfB/A NEIGHBORHOOD PLAYMATESt 9 MILL ST. First on the agenda was the public hearing on the request of Cindy Latino, d/b/a Neighborhood Daycare Services, Inc. seeking a use variance to be able to operate a Day Care Center at 9-11 Mill Street which is not allowed in a CB Zone. Secretary stated that Dutchess County Dept. of Planning hod responded to the zoning referral with a matter of local concern comment. Applicant presented to Board receipts of mailing her legal notice. It was noted that legal notice appeared in the April 28, 1999 edition of the Poughkeepsie Journal. Ms'. Hodge also stated she received a copy ora memo from Planning Board Chairman Visentin who is asking the Board of Trustees to enact legislation regarding where Day Care Centers should be located on the use chart. At this present time there is no clear definition of Day Care Center on the use chart. Ms. Latino presented her case. She stated she had a Day Care Center which she operated in the Zion Chorch far 15 years. About a year ago the Zion Church informed her that they would not be renewing her lease. Applicant set about looking for a new place to locate her Day Care Center. Her primary goal was to stay in the Village. Applicant went on to state she has two day care centers - one for school age children which is located in the Community Services building on Givans Avenue and the one thot was located in the Zion Church which is for infants through pre-school. When she saw that this site was going on the market she thought this site would be a potentially good site to relocate the day care center. She received a grant from a local corporation for renovations to the buiMing. She has had New York State Licensing Dept. out to look at the building and have approved the plans. She went on to state there is no clear definition for Day Care Center in the code and that is why they are applying for a use variance. She also stated she feels it is a great use for the building. It would also allow her to keep her business in the Village which is her primary goal. Ms. Latino stated that the grant is contingent upon her purchasing the building and purchasing the building is contingent upon receiving all necessary approvals.
