~MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 11/9/99 <br /> <br />Present: Susan Hodge, Chair, Lloyd Frink, Vice Chair, Harry Greco, Bob Morriz; and <br />Mary Ann Bolander, Secretary <br /> <br />Others Present: <br /> Armand Alfonso <br /> Bill Kart <br /> Ray Marshall <br /> <br />Lou Viglotti, Esq. <br />Dan Contelmo <br />Barbara Marshall <br /> <br />Meeting was called to order at 7:30 p.m. Roll call was taken and all members of the <br />Board were present. <br /> <br />B, !LL KARl{ FOR 30 SOUTHAVENUE <br />First on the agenda was the continuation ora public hearing on the request of Mr. <br />William Karr to be able to use the storefront at 30 South Avenue as a deli. Mr. Karr <br />presented a list of his expenses for the building and according to the list he has a <br />negative balance of $803. 42.(copy of this is on copy in the Planning/Zoning oj~ce files) <br />He stated that in order to turn the storefront into an apartment it would cost him <br />approximately $20,000.00. He also stated he talked to the person who is interested in <br />opening the deli and he stated he would be renting with an option to buy but without the <br />deli he is not interested in the building. Applicant also stated he has a letter from his <br />Real Estate Broker (a copy on file in the Zoning/Planning office files) stating that the <br />property is on the market for $250,000.00. She also states that the main sellingpoint on <br />this property is that is has a deli on premises. If the deb is removed, the building will not <br />be saleable, Even if the storefront was converted to an apartment, she feels it wouM <br />lower the value of this property. ~41so the expense for this project would make the sale <br />price of the building prohibitive and she feels the deli should be reopened He also <br />presented the Board a copy of the lease agreement. He again explained that there is a <br />leasee plus the leasee has subleased to another person. Mr. Frink asked applicant the <br />duration of the lease and he answered 99 years or a lifetime plus 21 years for both of the <br />leases. Mr. Greco asked who is paying the bills and Mr. Karr answered Mr. Dibble (the <br />subleasee) is except for some repairs that Mr. Karr is doing, Mr. Dibble does not pay <br />Mr. Karr rent, he pays the mortgage, taxes and all bills. Ms. Hodge stated she has <br />looked at the mortgage book and she noted that the mortgage is indeed $2,077.09/month. <br />It was stated that Mr, Dibble would reassign the lease to the person interested in opening <br />the deli. For clarification Mr. Karr is the landlord of the property and is acting as a <br />agent for Mr, Dibble. Mr. Karr also stated that Mr. Dibble is aware of everything that is <br />going on. Mr. Frink stated that one of the tests for the granting ora use variance is has <br />all other conforming uses for the building been looked into and Mr. Karr stated as long <br />as the building has been for either sale or rent no one beside a deli has shown any <br />interest. Mr, Kart stated that the original leasee (Amy FeiO owes hint about $20,000.00 <br />and when they stopped paying and Mr. Kart tried to get the building back by breaking <br /> <br /> <br />
