MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 2/8/00 <br /> <br />Present: Sue Hodge, Chair, Lloyd Frink, Vice Chair, Harry Greco, Bob Morris, <br /> Newell Russell and Mary Ann Bolander, Secretary. <br /> <br />Others Present: <br /> Trustee Davis <br /> Andy Klampert <br /> <br />Don Walker <br /> <br />Meeting was called to order at 7:3¥ p.m. Roll call taken by secretary. All present. <br />this point Ms. Hodge read the agenda for the meeting. <br /> <br />DV-8 NIGHTCLUBt ROUTE 9~ DUTCHESS SHOPPING PLAZA <br />First on the agenda was the application of DV-8 Nightclub located at II89 Route 9 <br />(Dutchess Shopping Plaza) with a request for an additional sign to be placed on a <br />neighboring building (Woodworker's Warehouse). Applicantpresented an affidavit of <br />publication of legal notice in the Poughkeepsie Journal and also documentation that <br />legal notices had been sent return receipt. Ms. Hodge stated Dutchess County Dept. of <br />Planning had responded to zoning referral with a "matter of local concern" comment. <br /> <br />Mr. Klampert stated the club is not doing the business they thought it would do and he <br />feels they need more exposure to vehicles traveling north on Route 9. He intends to put <br />the sign on the side of the Woodwarker's Warehouse portion of the plaza. He stated he <br />had a letter from the landlord giving him permission to do this. Applicant did not have a <br />sketch of the sign nor did he have any dimensions of the sign. Ms. Hodge informed <br />applicant that the sign, if granted, would have to be built to code. She stated you were <br />only allowed to have 2 sq. fl. of signage for each lineal fi. of building frontage and this <br />calculation would have to include all signs. She also stated applicant would have to go <br />to the Planning Board for their approval also. <br /> <br />Mr. Frink stated that applicant is petitioning the Board for a use variance and therefore <br />needs to present to the Board the following information which was explained to applicant <br />at the time he applied for the variance: competent financial evidence that a reasonable <br />return cannot be realized for the permitted use, e.g., financial summary, copies of <br />cancelled checks, receipts, income tax statements, bank statements to support financial <br />hardship. <br /> <br />Applicant stated again the club is not filled to capacity on a given night. He stated they <br />are advertising on radio and newspaper but it does not seem to be enough He feels the <br />public needs to see something in writing. <br /> <br />Ms. Hodge stated before the Board can reach any decision they need to have the <br />following information: dimensions of requested sign and dimensions of existing sign, <br /> <br /> <br />
