MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 11/14/00 <br /> <br />Present: Bob Morris, Acting Chair, Dave Crawford Newell Russell <br /> <br />Absent: Lloyd Frank, Harry Greco <br /> <br />Others' Present: <br /> Charles McCluskey <br /> Robert Kortright <br /> Dawns Chase <br /> Judy Morris <br /> Tracy Garrick <br /> Wiliam Karr <br /> Kathleen Masterson <br /> Mayor Betding <br /> <br />John Kernochan <br />Eileen Allen <br />Victoria Mathews <br />Robert Tillson <br />Ujina Robinson <br />John Nelis <br />Trustee Lawrence <br />Barbara Tomlins <br /> <br />Meeting was called to order at 7:30 p.m. Motion by Mr. Crawford and seconded by Mr. <br />Russell to accept the minutes from the Augn,st and September meetings. Unanimously <br />carried <br /> <br />EILEEN ALLEN~ 4 MARSHALL ROAD, <br />First on the agenda was the request for an extension of a variance by Eileen Allen, 4 <br />Marshall Road to allow for the operation of a self storage warehouse business at 4 <br />Marshall Road. This variance was originally approved on July 8, 1997. Mr. Kortright <br />representing his' mother stated the reason they are requesting the extension is that they <br />ran out of time to apply for a building permit. Nothing has changed since the original <br />variance was granted. Mr. Morris' made a motion to grant the extension, seconded by <br />Mr. Crawford. On roll call vote - Mr. Morris - Aye, Mr. Crawford- Aye, Mr. Russell - <br />Aye, Mr. Greco - Absent, Mr. Frank-Absent. <br /> <br />CHARLES MCCLUSKEY FOR 2596 SOUTH A VENUE <br />Next on the agenda was the application of Mr. Charles McCluskey, 2598 South Avenue <br />appealing as an Aggrieved Person objecting to a deck that has been built at 2596 South <br />Avenue. Mr. McCluskey presented the Board his proof of legal notice mailing and his <br />affidavit of publication fi'om the Poughkeepsie Journal. Secretary stated that the <br />D~etchess County Dept. of Ptanning had responded to the zoning referral with a "no <br />authority" comment, Mr, McCluskey stated that at a previous ZBA meeting, Mr. Kart <br />had made application to be able to have a third apartment in the deli portion of his <br />building at 2596 South Avenue. This variance was granted. Sometime in the summer, <br />Mr. Karr's tenant startedputtingfootings in the ground to build a deck right up to the <br />wall between Mr. Kart 's proper~, and Mr, McCluskey's property. Mr. McCluskey went <br />on to state that there is a question as to where exactly the property line is and he believes <br />it is three feet. There was no request for a variance and no building permit was issusd <br />for it. Mr, McCluskey stated the deck is nailed to the building, He went on to state that <br />the deck has the potential to suddenly turning into an enclosed space. He also stated that <br /> <br /> <br />
