A Public Hearing on a proposed local law entitled "A local law amending <br />Secti(~; 310 of the Village zoning Ordinance and the Zoning Map, Village <br />of Wappingers Falls, Dutchess County, New York" was held on January 26, 1994 <br />at 7:15 P.M. in the Village Hall. <br /> <br />Present: Mayor Hinzmann, Tr. Napoleon, Tr. DiDcmizio, Tr. Shay, Tr. Traver, <br />Tr. Bain, Tr. Usavich and Atty. Viglotti. <br /> <br />Also present: Mr. & Mrs~ Seaman, James Coombs & Rachel Molinaro, their <br />attorneys, and Mr. Seaman's brother, Mr. James Sedore. <br /> <br />Mr. Coombs addressed hearing and discussed background of the request which <br />was initiated in September, 1993, at which time, the Village Board declared <br />itself as lead agency for the purpose of conducting future envirorm~n~a] <br />review of the action. <br />He ad~lressed cuL,Lent outlined in his letter dated 1-10-94 which include <br />Village Planning Board recc~mnendations; response to D.C. Plaraning Depart- <br />ment's conditions for approval of the amendment; history of the property <br />which, he states, makes in conducive to c~,,;~rcial use. <br /> <br />Mr. Coombs reported that, if local law was enacted as written, owner <br />would be prevented frcm earning a livlihood and present intent was to <br />continue to sell and service vehicles on the property. <br />He stated they agreed not to operate a auto body shop, paint shop, paint <br />vehicles or store junked vehicles at the site. <br /> <br />Tr. Bain inquired as to period of t~me non-conforming use would be in effect, <br />under the present use, and it was determined for the life time of the property, <br /> <br />Tr. Bain also inquired as to why change was n~ded to continue to operate at <br />its present use. <br /> <br />Mr. Coombs replied that, in the long run, to continue operations under its <br />present use would be futile and appropriate use of property would cc~e %Lnder <br />Neighborhood Business classification. <br /> <br />Tr. Bain reported his concern was that there was no cc~mprehensive plan for <br />this area and this type of zoning will continue to spread in this section of <br />the Village. <br />He said he was concerned with what type of busLness would operate at the site, <br />shoud zoning change be granted. <br /> <br />Mr. Cocmbs reported any use at th_is site would recp~4re Planning Board approval. <br /> <br />Tr. Napoleon reported Village Planning Board recc~t~,~nded zoning ch~lnge be <br />granted. Carried. <br /> <br />Mr. James Sedore addressed hearing stating this was a hardship case and for <br />Mr. Seaman %0 lose the use of his property was to take away his livlihood <br />and his only recourse was to sell property as a cca~nercial parcel. <br /> <br />Public Hearing closed <br /> <br />7:50 P.M. <br /> <br />Village Clerk <br /> <br /> <br />
