<br /> <br /> <br />6/13/07 <br /> <br />Minutes following the Village Mayor and Board of Trustees meeting 6/13/07. (The Clerk <br />of the Village, John Karge, was attending NYCOM so the meeting minutes were taken by <br />Eileen Sassmann.) <br /> <br />Public HearingLocal Law #3 2007 – Establish Towing Ordinance. <br />: <br /> <br />Village Attorney Viglotti described the intent of the ordinance (to provide and orderly <br />scene at an accident) and then read the proposed ordinance. The main provisions of the <br />proposed ordinance are: a permit application process, yearly permit schedule, call out <br />procedure and the list of qualifications for businesses. The list of qualifications for <br />businesses include: located within a five-mail radius of the Village, show proof of <br />insurance, provide a secure facility to keep vehicles, and provide access to the facility <br />8AM – 6 PM. Many of the businesses interested in being on the towing list offered <br />comments on the proposed ordinance. The following are the important points that were <br />discussed during the hearing: <br /> 1. Many of the members of the audience recommended that the radius of 5 miles <br />be changed to 4 miles to limit the number of possible businesses. The speakers felt that 5 <br />miles allowed too many businesses to qualify for the list. Attorney Viglotti felt that this <br />change could be made to the proposed law. <br /> 2. It was recommended that the radius for possible businesses be chosen starting <br />at the stone bridge on East Main Street in the middle of the Central Business District. <br /> 3. There was concern that not all applicants could provide a secure facility <br />available for access from 8 AM to 6 PM. Attorney Viglotti indicated that the pick up time <br />could be changed in the proposed law. <br /> 4. It was suggested that there be a cap on the number of businesses on the list. <br />Attorney Viglotti indicated that he would need to investigate this new aspect of the <br />proposed law. Attorney Viglotti reported that none of the local laws he reviewed in <br />preparing the proposed law contained a cap. It was reported that the Town of <br />Poughkeepsie has a cap of 12 on their list. Attorney Viglotti said he would consult with <br />the Town of Poughkeepsie Attorney. . <br />Trustee Visentin will schedule separate meeting with the towing businesses to discuss the <br />updated ordinance. Trustee Visentin made a motion to close this public hearing, seconded <br />by Trustee Weitlich. Carried. <br /> <br />Public Hearing: Local Law #4 – Permit Alternate Member to ZBA 2007. <br /> <br />Trustee Visentin described the need to have an alternate member for the ZBA: to ensure <br />that there is always a quorum available to vote on the issues at each meeting. Trustee <br />further noted that the alternate would attend the same training as regular ZBA members. <br />There were no additional comments on the proposal.
