Please refer to <br />OCAL AW <br /> <br />the following as proposed amendments. <br /> <br /> <br />Section 146 of the Code of the Village of Wappingers Falls shall be amended so as to add <br />the following Sections: <br /> <br />Section 146-10 CATCH AND RELEASE OF FISH AND AQUATIC WILDLIFE <br />The Village of Wappingers Falls shall maintain “Catch and Release” of all fish species <br />taken by any person from the Wappingers Lake. Unless taking a fish to an official <br />weigh-in station during any angling tournament, all fish species must be immediately <br />released without any intentional harm. Measuring, weighing and photographing of the <br />fish are permitted as long as the fish is not removed from the water for an extended <br />period or handled in a manner that could cause it harm. Furthermore, unless being <br />transported to a shore weigh station as referenced above, fish taken from the Wappingers <br />Lake may not be placed in a bucket, tub, live well, on a string or any other holding <br />device. Bait fish are excluded. <br /> <br /> <br />Section 146-11 REMOVAL OR INTENTIONAL KILLING OF AQUATIC WILDLIFE <br />The intentional capture, removal or killing of any aquatic wildlife, as defined in the New <br />York State Environmental Conservation Law from the Wappingers Lake or along the <br />shore lines is strictly prohibited. This section shall include but is not limited to: Birds, <br />Ducks, Geese, Turtles or eggs of such wildlife. <br /> <br />Section 146-12 NETTING <br /> <br />The use of a net to capture any species of fish or aquatic wildlife is prohibited except <br />where such net is used by an angler engaged in the act of fishing by reel and pole and <br />such net is used to assist the angler legally landing such fish. <br /> <br />Section 146-13 UNATTENDED CAPTURE OF FISH <br /> <br />No person shall engage in unattended capture of any fish in the water body of the <br />Wappingers Lake. Unattended Capture shall be defined as baiting of any hook, net, pot <br />or other device designed to capture fish and left unattended for more than thirty (30) <br />minutes with the intent to retrieve said captured fish at a later time. <br /> <br />Section 146-14 SWIMMING FROM A BOAT OR OTHER WATERCRAFT <br /> <br />Page 1 of 5 <br /> <br /> <br />
