MINUTES OF PLANNING BOARD MEETING HELD 9/7/07

Present: Tom Morris, Chairman, Lisa Firstenberg, Vice Chairman, Don McCormick, George
Moran, George Kolb, Kristina Costa and Mary Ann Loncto, Secretary

Others Present: Trustee Calabrese Trustee Marshall
Code Enforcement Officer Fenton Jay Paggi
Michele Greig Attorney Horan
Eileen Sassmann Eric Neiler
Mike Collier Rachel Castro
Steve Tinkleman Barbara Fitzgerald
Jack Nasi Arnold Restivo
Allen Firstenberg Luke Camaj
Lindell Simmons Renato Pistolesi
Gil Mulholland Mary Smaltz
Al Capelli John Zuccaretti
Lou Snell Lou Fiorese
Dominic Porco Mary Smaltz
Daniel Quezada Walter Priede

Meeting was called to order at 7:30 p.m. There was one change to the August meeting minutes – Page
3 under “Dirty Bassardo's” - Line 24 should be Code Enforcement Officer not Ordinance - Mr. Kolb
made a motion to approve the August minutes as amended, seconded by Mr. McCormick.
Unanimously carried.

MID HUDSON SUBARU, ROUTE 9
First on the agenda was the proposal from Mid Hudson Subaru to be able to replace existing Kia
signage at the above above. Mrs. Fitzgerald passed out copies of what currently exists versus what is
proposed. She also gave color samples to the Board. It was stated that the new sign would be 5 ft.
taller than the old sign. Mr. Morris asked Mrs. Fitzgerald how the height of the proposed new sign
relates to the height of the building – the building is 20' and the proposed sign is 25'. Mr. Morris
reminded the applicant that the sign ordinance states that the sign cannot be taller than the building.
Mr. Morris also asked applicant if the sign has to be a pylon – can it be a monument sign. Applicant
stated yes it has to be a pylon sign so it can be visible. Mr. Morris asked visible for what – cars or
airplanes – and applicant answered cars. Mr. Morris then pointed out that there were too many signs –
the ordinance states only two signs per unit of occupancy – but all signs are within the allowable square
footage. Mr. Morris went on to state he has no objection to the Mid Hudson/Service sign and the Logo
does not count as a sign – so, applicant has to decide which two signs she wants – the pylon, and the
two Subaru signs on the building – Mr. Morris again stated he would prefer to see a monument sign
instead of the pylon and Mr. Kolb asked if applicant was aware that within the next year the Village
may be changing the sign regulations for Route 9 and they will have to come into compliance within a
certain amount of time. Ms. Firstenberg stated if applicant will not consider a monument sign then will
they consider something that is more architecturally pleasing and applicant stated no they would not –
what they are proposing is a corporate sign and there is nothing else in their program. Mr. Moran, Mr.
McCormick and Ms. Costa all state they have no objection to the proposal as long as there are only two
signs and pylon is dropped to the allowable 20 ft. and applicant is aware that in the future they may
have to change their signs to be compliant with code. Mr. Kolb made a motion to approve the proposal
contingent upon (1) pylon sign is no higher than 20 ft., (2) removal of the southern most Subaru, (3) all
other signs remain same sizes and locations as presented and (4) applicant supply updated copies that
