On roll call vote – Mr. Morris – Aye, Ms.
Firstenberg – Aye, Mr. Moran – Aye, Mr. McCormick – Aye and Mr. Kolb – Absent.

FISHERMAN'S WORLD, 10 MARKET STREET
Applicant informed Board secretary earlier in the day that he would not be present at the meeting.

HEART KIA, 1607 ROUTE 9
Next on the agenda was a discussions with owners of Kia for change to Subaru on Route 9. Mr.
Swartz stated at this moment in time the transition from Kia to Subaru at that location is taking place
and they will be before the Board with a full application including permanent signage. At this time
what they are proposing to facilitate the transition is to cover up the Kia signs on the buildings until
such time that there is a formal approval for the Subaru signs – they are looking for approval for a
temporary sign - just a bag over the existing Kia sign an over the Kia logo on the building. Mr. Nasy
th
stated he would be having a closing on the 26 of July, 2007 for the change from Kia to Subaru. They
are asking to have the temporary sign up for an extended period of time (one year until the project is
done) because the Ordinance only allows 2 weeks with a 2 week extension from the Zoning
Enforcement Officer. Mr. Morris stated he feels the applicants can get a sign done in less than one
year and Mr. Swartz stated they can get it started as soon as the Board approves it. Applicant stated
that the existing sign will come down and a new sign will be installed for Subaru. Mr. Morris stated he
would have no objection to granting a temporary sign permit for 3 months with one 3 month extension
– approved by the Board. Mr. McCormick asked how the Planning Board could vote on superseding a
law that is already in the Code Book (i.e., it specifically states that a temporary sign is only valid for 2
weeks with one 2 week extension). Mr. Fenton stated he would get in touch with the Village Attorney
and ask for his interpretation of this. Mr. McCormick stated applicants should look into putting a
“construction sign up which read coming soon, new home” of or something similar to that. Applicant
was also reminded that there are size restrictions on Announcement Signs. Mr. McCormick made a
motion to allow the change of name from Heart Kia to Mid Hudson Subaru. Motion seconded by Mr.
Moran. Unanimously carried.

BOSTWICK, 789 OLD ROUTE 9
