A Public Tearing was held on October 10, 1984 at 7~05 p.mo on <br />proposed Local Law #5 regulating Outdoor Storage of Abandoned, Junk, <br />Discarded or Unregistered Notor Vehicles. <br /> <br />Present: Mayor $~ett, Trustees Boyle, Carey, and Greco, Att,y Reilly. <br /> (Trustee Costa was ill; Trustees Mazochi and Cioppa, working.) <br />Att0y geilly explained the proposed law with specific reference to <br />the provisions giving the Village authority to remove said vehicles. <br /> <br />'Nillie Neu~an of Oak Pa~k asked how long would the procedures take. <br /> <br />Mr. Reillyexplained that upon a co~plaint being placed with the <br /> <br />ZoningLEnforcement Officer, th~ property ~ener is given apprm~i~atily <br />ten days in which to respond, zn order to fulfill the requiremnts of <br />adequate notice. <br /> <br />Charle McCluskey, 28 South Avenue asked what were the penalties. <br /> <br />Mr. Reilly stated that the proposed law provides for a'fine of $100 <br />or a sentence of 15 days, each day that the alleged violation continues <br />cou~ting as a separate offense. <br /> <br />Nfs. Martinez~ 14 Dutchess Avenue asked how many vehicles would <br />constitute a violation. <br /> <br />Mr. Reilly explained that'one vehicle could place the property ~wner <br />in violation i~ it met the statutory definitions.of abandoned, ~unk, <br />discazddd, etc. <br /> <br />A resident rrm Oak Park inquired what h~ppens if smaeone else <br />abandons a car on your proper~y, as this happens repeatedly in her area. <br /> <br />Att'y Reilly stated that the ten days notice provision is to allow <br />the property owner time tO ~ateea~a~ defenses, e.g. that they did <br />not abandon the vehicle, or that it is not ~unk. Ne further stated <br />that if the property o~ner disclaims owning the vehicle involved, the <br />police would then investigate who the rightful owner ~ay be. <br /> <br />Joel Ne,,mm"A of Oak Park inquired as to how would it be determined if a <br />vehicle was in violation. <br /> <br />Mr. geilly stated that this would be determined by the Board based <br />upon the physical evidence. <br /> <br />Trustee Boyle observed that the law Pertains to all motor vehicles; <br />not ~ust automobiles. <br /> <br />Mr. Reilly stated that it would not apply to boats, but would apply to <br />any trailer used to transport a boat. <br /> <br />Mrs. Ne, man inquired as to how a property owner would prevent a <br />reoccurence, once vehicles were removed. <br /> <br />Mr. Reilly expl&ined that that was up to the property owner who would <br />be well-advised to secure his/her property in s~me manner with perhaps <br />a chain or a fence if she were concerned about others abandoning <br />vehicles on her property. <br /> <br /> <br />
