<br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 1/8/08 <br /> <br />Present: Lloyd Frink, Chairman, Frank Barresi, Vice Chairman, Allen Firstenberg, <br />Scott Davis, George Dansereau and Mary Ann Loncto <br /> <br />Others Present: <br /> Kevin Ward Scott Leary <br /> Jane Travis Sally Trabucco <br /> Joe Indovino Michael Trabucco <br /> John Fenton Mark Parella <br /> <br />Meeting was called to order at 7:35 p.m. Secretary took roll call. All members present. <br /> <br />ELANT NURSING HOME, 37 SOUTH MESIER AVENUE <br />First on the agenda was the request of The Great American Sign Company seeking a <br />variance from Section 151-12(G)(3) of the Zoning Ordinance to be able to have a larger <br />sign than allowed by Code for Elant Nursing Home located at 37 S. Mesier Avenue. At <br />this time the applicant submitted for the record his notice of publication which was <br />published in the December 19, 2007 edition of the Poughkeepsie Journal and proof of <br />mailing of legal notices. It was stated that on the record was documentation from the <br />property owner allowing Mr. Leary to represent them. Also on file is a letter from <br />Dutchess County Department of Planning dated January 8, 2008. It was stated that the <br />proposed sign is slightly larger than the existing sign – the existing sign sits between the <br />posts and they would like to use the outside edges of the post – essentially the sign would <br />be mounted to the face of the posts instead of inside of the posts. Mr. Frink asked the <br />applicant why he felt the dimensions of the sign needed to be 36” by 60” and applicant <br />answered that they are looking at letter heights to be approximately 7 inches – it is a 30 <br />mph road and the larger the text they can maintain on the sign the easier it is for motorists <br />to read it for safety reasons. They also want to use the applicants logo and in order to use <br />that – they need to “push” the lettering to the right side of the sign to allow the logo to be <br />in proportion to the sign. Mr. Frink asked if the applicant could use a post/arm sign <br />instead of a monument sign and applicant stated they would not be able to maintain the <br />letter size. Mr. Frink asked the applicant to maintain the letter size for length of the sign <br />he would require a 4 lineal ft sign and he answered at 4 ft. the text area would be crowded <br />and difficult to read. Mr. Frink then went on to state that two concerns of the proposed <br />sign would be (1) it is not subservient to the street space and (2) it does not allow visual <br />continuity to the neighborhood and Mr. Leary stated that the existing sign does not <br />conform to either of those things either and they did base their concept off the existing <br />sign thinking that the Village had approved that type of sign in the past. It was stated that <br />“Elant” has other locations and the sign design would be the same. For the record it was <br />stated that the Village speed limit is 25 mph. Mr. Firstenberg asked if the sign had been <br />before the Planning Board and applicant answered no but he was planning to go to the <br />Planning Board if and when he got the approval from the ZBA. Mr. Frink stated for the <br />record there is no commentary from the Planning Board. <br /> <br /> <br /> <br />
