Unanimously carried. <br /> <br /> PROPOSED SIGN FOR F,4LLq DINER} 5 EAST MAIN STREET <br />First on the agenda was the application for a new sign at Falls Diner. The Board <br />reviewed the application and it was noted that sign would be 2fl. from the building. The <br />sign would measure 5'x 3 '. Mr. Visentin read a letter from the New York State Dept. of <br />Transportation dated November 5, 2001 regarding canopies and signs on buildings on <br />Route 9D which states that a permit has been issued to cover the cantilever awnings and <br />signs hanging off the front of the buildings on South Avenue. It was issued to <br />"....promote social and historic traditions and economic revitalization." It went on to <br />state that the Village has its own permit and as long as the signs meet with Village <br />regulations, they will not need a state permit. Mr. Morris stated for the record that he <br />would like the State to send a follow up letter to the Village stating the intent of this <br />permit would be for 9D not just South Avenue as stated. Mr. Visentin went on to state <br />that according to the Zoning Ordinance it states no one can have a sign in the Right of <br />way- the Ordinance does not state any particular right of way - therefore anyone who <br />wants to put a sign in the right of way would have to go to the ZBA for permission. It <br />was also stated that the Planning Board would write a letter to the Board of Trustees <br />regarding removing or revising this section from the Zoning Ordinance. At this point Mr. <br />Morris made a motion to approve the sign contingent upon (1) granting of variance <br />regarding the right of way concern, (2) written clarification ora letter from DOT <br />regarding South Avenue vs. Rt 9D and (3) revised dimensions - 3 'x5 '.
