Mr. Karge introduced Mr. Hood as the newest
member of the Planning Board

BOTTINI MATTER- 18 CLINTON STREET AND WEST MAIN STREET
First on the agenda was a preliminary discussion regarding site plans for Bottini
properties at 18 Clinton Street and West Main Street. Mr. Cantor presented the Board
the escrow check as requested. The topic of the discussion would be the notes the Board
received on the drawing relative to property at West Main Street. Ms. Van Tuyl stated at
the last meeting the application and proposed site plan maps were referred to the
Village's consultants for comments. She went on to state that this application actually
arises out of discussions being held in a context of a present appeal that is pending by the
Bottini's to the ZBA seeking an interpretation relating to an enforcement action that was
brought against them. A resolution is trying to be reached. Basically the resolution
deals with the applicants being willing to abandon any claims to the lawfulness of certain
uses on Clinton Street in exchange for which they would seek to do them on the West
Main Street property. Obviously anything that the Village would agree to could never
supersede the Planning Board's authority over site plans. As it happens there are notes
on the previous site plan for the southerly Bottini site on West Main Street that would
preclude the applicant doing anything even though they are lawful under zoning. The
Planning Board has received applications for two different site plans. One is a
amendment and the other is an initial site plan. The first is an amendment of the existing
site plan for the southerly of the two sites on West Main Street. The only amendment that
is sought at this point is to delete three of the notes from the previous plan and add one
